If your injuries are more serious and you meet the requirements set out in the Insurance Act, R.S.O., 1990, c.I.8, as amended, for pursuing a lawsuit for pain and suffering, you may need to put your own insurance company on notice.

Consult with a lawyer or licensed paralegal that specializes in this area of law. For accident benefits purposes, these claims are typically presented to your own insurance company. If you do not have a policy of insurance, there is a hierarchy of insurers whom would be responsible for adjusting your accident benefits claim. |

I was in a motorcycle accident, but was not wearing a helmet. Am I entitled to receive benefits? |

Certain benefits may be withheld from you if you have been convicted, as a result of the motor vehicle accident, of a criminal offence. However, not wearing a helmet does not generally result in criminal charges being laid. |

It depends. There are a number of factors which must be considered including whether or not you had notice of these broken steps, whether the landlord had notice of the broken steps, the location of the broken steps, what caused them to break, whose responsibility it was to maintain and repair the steps, etc.
