Q.
Do you charge any up-front fees to represent my claim?
A.
NO, we get paid only when you do.
Q.
I was paralyzed in a car accident. What is the maximum settlement I can hope for?
A.
With injuries as serious as this, it is not only a question of how much money you should expect to settle your case for, but also a question of what sort of care you will require to make your life as comfortable as possible. Certain medical and rehabilitation programs must be implemented to ensure you are getting the care you need. You may qualify for what?s knows as a Catastrophic Impairment. With these types of impairments it is important that your every need to looked after by the appropriate legal team.
Q.
I broke my hip after I slipped on my neighbour?s icy sidewalk. What should I do?
A.
The first thing you need to do is obtain the appropriate medical attention. As far as any legal concerns you may have, it is important to determine rather quickly where the actual fall took place. If the fall occurred on City property, the time periods for putting the City on notice are very short. Additionally, you may wish to obtain photographs depicting the area where you fell. Also, it is important to preserve your shoes or boots, to be able to show at a later time that you had proper footwear when the accident occurred.
Q.
How soon after my accident should I seek legal advice?
A.
You should seek legal advise immediately. Because of the complexity of the law, it is in your best interest to hire a lawyer or licensed paralegal who specializes in this area as quickly as possible. I was enrolled in university when I had my accident, and can?t complete my studies. The Statutory Accident Benefits Schedule, Accidents on or After November 1st, 1996, addresses this type of loss. A claim for reimbursement of your tuition costs and school-related expense may be submitted.
Q.
What can I do about my lost tuition fees?
A.
Tuition fees can be claimed back under accident benefits. See above.
Q.
Should I fill out the insurance forms myself?
A.
It is not in your best interest to fill out insurance forms yourself. It is always important to have your lawyer or licensed paralegal complete the forms on your behalf. It is important to remember that insurance forms are kept on record by the insurance company and the information you provide can be used against you at a later time.
Q.
How long will it take to settle my claim?
A.
It depends on a number of factors. The regulations disallow the settlement of an Accident Benefits claim until after the one-year anniversary date of the accident. Additionally, a lawyer or licensed paralegal specializing in this area will want to take certain strategic steps such as arranging for certain types of assessments, before settling your file, such as to optimize your results.
Q.
How long do I have to file a police report after a car accident?
A.
Pursuant to s. 200 of the Highway Traffic Act, R.S.O., 1990, c.H. 8, a person in charge of a motor vehicle who is directly or indirectly involved in a motor vehicle accident, has a duty to remain or immediately return to the scene of the accident, render all possible assistance, and upon request, give to anyone who sustained a loss or injury or to a police officer or to any witness, his or her name, address, drivers license number and insurance information. As such, it is in your best interest to report the accident as quickly as possible and preferably immediately or on the same day.
Q.
An insurance company has offered me a settlement after an accident. Should I seek legal advice before taking it?
A.
Yes, typically insurers will not give you their best offer without you being represented by a lawyer or licensed paralegal that specializes in this area of law.
Q.
Is there an average range for what I can be awarded for my pain and suffering following an motor vehicle accident in Ontario?
A.
No. There is no average. There are very many factors that affect how much an insurance company is willing to settle a file for. Given the complexity of this area of law, it is in your best interest to consult with a lawyer or licensed paralegal that specializes in this area of law.

TESTIMONIALS

We are very happy with how our case turned out. My wife was worried we would never see the money from my time lost at my job. I called you the day after my injury and from that point on, I felt very positive about our claim. My injury from a fall on a broken sidewalk turned into a out-of-the-court settlement, with recompense for hours lost at my job. We are impressed with your service.

After my accident, I immediately called these people. I was afraid for my family because I was not able to go to work for a long time. When I wasn?t working they were fighting for me, and they got me to pass a long case with a final settlement my family could be proud of.
