Q. In a car accident..passenger injuries and insurance fraud?
my friend and i were in minor rear-end collision a few weeks ago. another student hit us at about 35-40 mph and my car sustained about $2,000-$3,000 worth of damage and sent both myself and my friend to the er. i'm content with settling around an offered $2,500 to cover my er visit (minor strains and bruising) and pain and suffering, plus my car will be fixed and i will move on with my life. my friend, on the other hand, who went to the same er with back pain, now has an attorney and would like to settle with $20,000 and atleast $5,000 in pain in suffering. on top of that, she would like to "dip" both into my insurance, the other driver's insurance, and her own insurance, in effect tripling that figure. i'm bothered by this and the fact that she claims she needs all of that money to pay for medical bills and physical therapy for the next two years because of her injuries (now its gone from minor back pain to cerebral bruising - concussion! - and bulging discs, of which she has now has no symptoms). she runs to class every morning on my campus with a backpack full of books! i feel like this is fraudulent on all insurance companies involved. what can i do about it?

I'd call the adjuster handling the claim for the at fault car. Tell them what you have told us. Let them know about your friend running to class with the back pack full of books and when/where/what time of day she does this. Then if they want to send a PI to take some photos they can. If she is claiming a bunch of injuries that she did not have - then, yes what is is doing is fraud and the fact that she has targeted your policy as well do go after shows you exactly what type of friend she is.

i was injured in a car accident as a passenger, my friends insurance company are saying that i'm not covered for the injury and i must make a private claim, even though the accident was not my friends fault, we were hit from behind. surely this claim should be handled by my friends insurance company? all they did was send me details of a no win no fee company and i'm not happy with this arrangement. can anyone help me please?

You claim to the other drivers insurer. Obtain their details from your driver, or if you cannot from the police. Ensure your accident is reported to the police asap and get the reference number from them. If you don't and the other drivers details are false (using false plates and gave incorrect name for example) you can only claim if the accident was reported to the police within a very short time of the accident. The best way to claim without the hassle of dealing with their insurer is to contact a solicitor near to your home that does no win no fee accident claims . This is because they have a local reputation to maintain and will treat you properly. Claims companies that aren't solicitors just sell your claim to a solicitor. This means the solicitors time dealing with your case is reduced because some of the money is lost to the middleman. If you raise the claim yourself (and you may have to if it is not accepted by solicitors e.g. very minor injury) the insurer will take advantage of your ignorance of the rules and unwillingness to use the Courts to rip you off. They have the advantage of playing this game so often they know what they can get away with.

Q. If i make a peronsal injury claim, will it affect anyones car insurance?
i was in a minor car accident, i was a passenger, we drove into a ditch, there was no other car involved. i have serious whiplash and i was wondering if i put a personal injury claim in, will it affect the drivers insurance, he is a good friend and i don't want his insurance to go up or for him to be affected in any way by me making a claim. is this possible?

If they have protected no claims bonus then there will be no effect. Otherwise the claim is a claim so the driver would not qualify for a no claims status. Perhaps the driver has had to pay to fix the car. If so they may have already involved the insurer and your claim would not break the no claims duck. The driver has an obligation to report the incident to the insurer which will have some effect on the no accidents issue - some insurers count this as a claim and others take the incident with no claim into account when setting premiums. You have 3 years to raise a claim. It is important to be able to prove you were injured in the incident if you change your mind in future. If you have whiplash seek medical help, this will create a record of what happened for you.

Q. Car accident insurance coverage question?
my friend got into a recent car accident on the freeway in l.a. a car cut her off on the highway and forced her to hit a big rig. the car left the scene and the only thing was recorded (car and make/model of vehicle). also, another car was forced into an accident from the hit and run driver. hitting the big rig too. a police report has been filed. however, there were some passengers in my friend's car who are also hurt. if my policy is purchased one way and no medical payments coverage, is it enough proof and evidence to convince the insurance carrier to open up a uninsured motorists bodily injury and property damage claim? also, the car is seriously damaged. should i even take the car out from the tow yard?

YES you should get your vehicle out of the towyard asap. This is something you DO NOT want to mess with. There are many legal factors coming into play, some of which have nothing to do with each other, some do. Joint & several states that if any one (in your case, any of your passengers) can prove negligence on YOU, you owe them under your BI coverage, whether it's 1% or 100%. (This is NOT the same as being considered at fault.) In THIS case, they'll come after you b/c the hit & run person is unknown, and your insurance is considered "deep pockets."; Basically, they can pick who they recover from. But this is a legal question for a jury to decide. Comparative Negligence in CA says that very rarely are all parties in an accident free of negligence, the actions of ALL drivers are looked at to determine fault (in a nut shell). If you are deemed 10% at fault, this is not "at fault." In CA, you are considered at fault if you are 51% or more liable for an accident. In CA, you actually may have an exposure under YOUR uninsured motorists claim up to your "negligent free" amount. If you are 10% at fault, you can only recover 90% of your injury damages under your UM coverage. If you are 100% at fault, you recover nothing under your UM coverage. Your passengers however, are innocent parties and they will be able to recover 100% regardless.

i live in ca, where i got into a car accident that wasn't my fault. my friend was in da car and she is claiming back aches (which was a pre exisiting illness of hers) the insurance guy verified i had valid insurance b4 he paid out the injury claim. i am no longer claiming injuries, but my friend is. would she have to have valid insurance for him to pay her for bodily injuries, since i am no longer pursuing my claim?

No. If she was injured, she can file a claim against the at fault party. Just because you were not injured does not mean she was not. However, while she may think she is pulling a fast one, the claims adjuster will find out her back injury was pre-existing. Her claim will be evaluated and a reduction for prior the prior condition will be considered.

i had a car crash last night no one is severely injured thank god. a car t-boned my car from the left where my friend was sitting. it turns out its my fault. my friend now wants to claim for her very very minor injuries and has spoken to a lawyer. what are the procedures do i go court or does my friend lawyer just claim from my insurance and i don't get involved. i have comprehensive cover with zurich . thank you how involved will i be because i am very scared to go court?

you won't go to court, as long as you are insured and legal, and weren't driving recklessly or DUI, then your fine. People like your ''friend'' are quick to scrape quick easy money wherever they can and car accidents are a sure win , tell your insurance, let them know that a passenger is claiming personal injury, their lawyers and defense teams will fight for it -- you should.nt be involved, they will ask you if you want to be kept informed of proceedings though, you can say no and that's that. As for your friend, have nothing more to do with her, i had an accident back in my 'boy racer' days and crashed into a curb at 35mph....strong race wheels meant no body damage!! but my friend (who was into it too) got whiplash and didn't even think of claiming.... PS, insurance companies are used to fending off petty calimers with not much wrong with them, but even if she wins, its no concern to you, ill assume you are claiming for your car, so a claims a claim regardless of what she gets, it all counts as the same claim, i've lost sleep over accidents before, but remember this is a daily process for a major insurance company

my friend is the driver at fault in a automobile accident and i was a passenger of my friend's car. she has $1 million third party liability coverage with td insurance. if i claim third party liability with her insurer to cover my injuries and pain and suffering, will there be any consequences for suing her? or will be all be covered by her insurance coverage?

Having been the driver in that scenario I can tell you that her insurance rates are going to sky rocket . Mine literally tripled for 3 years. As long as you do not sue her for more than her policy limits nothing more will be done to her.

Q. Should i make an injury claim from this accident?
i was in a car crash this morning at half8 on a motorway. traffic was building up so we were only travelling at 20mph when we bumped into the back of another car. i was in the front passenger seat and there were two other passengers in the back. my friend got slight whiplash but she's fine now, and the other passenger and driver were unhurt. i however have been to hospital - i have whiplash, severe muscle tissue damage on my shoulder, an injured back and possible concussion. i'm very nauseous and dizzy, and have found out that just for my shoulder and neck alone i could get around £15000 and that's not the highest price i've found. thing is i go to college with the driver and it could cause me to get a lot of grief off people. if i wait a few weeks to claim until he has left the college how much could my claim go down by and what is everyone's opinion on what i should do? i barely know the guy to be honest i only speak to him when i'm getting a lift in the morning and even then he barely holds a conversation with me. also how much will his insurance go up by?

I guarantee they will check every single aspect of your claim. 3) I would be very sceptical of suggestions of payments in the region of £15,000. Payments are assessed by an independent Doctor, who looks at the medical evidence of pain and suffering and any possible future loss of physical capability. 4) If you delay making a claim this will definitely bring your credibility into question. 5) The decision on the moral dilemma, to claim or not is a matter of personal choice. Don't let ambulance chasing lawyers influence that decision. 6) Be wary of lawyers promising compensation. Read the small print of "No win no pay" schemes. It is not unheard of for clauses to include that you do indeed have to pay if they loose. (when was the last time you met a poor lawyer?)
