Usually the driver of the vehicle that is reversing is at fault for not making sure the entire area he/she is backing into is completely clear , but each case is different. The uninsured driver may be cited, at the least and perhaps more than that. The insured motorist hopefully has the Uninsured Motorists Coverage for just this event

Me and another car bumped in my school parking lot while backing out, whose fault ? so, i was backing out a parking space, i checked in my rearview mirror and turned back, no cars, no people and pulled out at normal speed, and as i was doing so, i heard this crack and i was like crap. i parked, got out, and i saw this car that backed out right behind be nailed me right in the left side corner of the bumper. when we got settled and re parked, i looked at his damage, and i hit kind of above his right side, back wheel and when he pulled out of the accident it kind of scraped him and my car. there was less damage to his car, and way more to mine, but whose fault?
i mean yea he was was telling me it was my fault because since i hit him not in the bumper and more on the side it was my fault, but under the circumstances i think we both tried to go first and he just pulled out faster than me.
im 17 and this is my moms car and im on her insurance, but whats going to happen? i heard theres such thing when both people are blamed for it, does this go on my record?

Got hit in a parking lot by a car reversing out of a spot, who is at fault? on friday i got into an accident. i was at a 4 story parking structure making my way down from the 3rd floor to the 2nd floor. i had to make a sharp right turn to take a small ramp down to the 2nd floor, then another sharp right to continue on the 2nd floor that leads to a ramp that takes you to the 1st floor and out of the lot.
the guy was parked exactly 2 spaces next to the sharp right turn i needed to take to proceed on the 2nd floor of the parking structure.
as i approached the ramp on the 3rd floor i slowed down. made the turn went down the ramp made the 2nd turn onto the 2nd floor and proceeded to drive towards the other ramp. all of a sudden after making the sharp right turn a car backs out of the 2nd parking space next to the ramp and i couldn't brake in time to avoid the collision. i tried to swerve out of the way but he hit me.
who is at fault? i don't think i am because i was passing his parking space just as he was pulling out and he continued to back up. he hit the bottom right corner of my passenger door and the fender of my front right tire. i dented the right corner of his rear bumper.
-when we got out of our cars to exchange info the first thing he did was accuse me of going fast but i was only going 6mph the minimum for the parking lot is like 10 or a little more.
is he at fault or am i?
-i looked at the speedometer just before i got to the ramp that leads to the 2nd floor, and it read 6mph. even if i was going that slow i had no time to stop becuz i was passing his car as he was pulling out. by the time i tried to swerve and hit the brakes it was too late.
-i told the insurance company that if it was my fault then my front bumper would be severely damaged. since it wasn't damaged and it was only the passenger side door and the fender on the front right tire it means the guy waited until i got close to his car to back out. that means he aimlessly backed out without looking i guess.

Usually, the person backing would be judged at fault but that is not for you, the other driver or me to decide. Simply turn it in to your insurance company and they will handle it

My car was parked and hit by insured driver who was hit by uninsured driver who was at fault? my car was parked on the road outside of work legally. a car pulled out of my work car park (which i could not park in due to lack of spaces) this car hit a car driving down the road in the side, forcing this driver to hit my car on the opposite side of the road. due to the force of the hit my car then hit the car parked behind mine.
the police were called and the driver who pulled out of the car park was found at fault. this driver was also found to have no insurance (romanien!!!)
however, i was hit by the driver who had insurance? my car looks like it will be a write off so not very happy. who do i claim from???
would i be rite in saying the car mine hit (parked) claims from my insurance. my insurance company claims for my damages and the other car from the insured driver who hit me! then the insured drivers insurance will have to try can claim the damages back from the uninsured driver?
i don't really want to lose my 4 years no claims and have to lose a lot of money due to exsess? any ideas?

just to make it clearer. car a pulled out into car b making car b hit my car (car c) which was parked with no one in it. due to impact car c hit car d.
car a had no insurance
car b,c and d did have insurance.
as car b hit c - c needs to claim from car b. hope this makes more sense...
