    Parking lot accidents are no fault and you don`t lose points. Your insurance is usually not affected because charges are not laid.

    Q. I'm no-fault car accident person. how can i reclaim my car insurance collision deductible back?
    hi, i live in the state of florida (usa) which is a no-fault law state. i had an accident where my car was hit from the back (which i am no-fault). the driver of the other car didn't have car insurance and his tag was also expired. unfortunately my car insurance couldn't have any response from him yet regarding my car repair’s payments. my collision deductible is $500.00 dollars, which i already had to pay to get my car back. now, from what i have heared, car insurances have several ways to collect this money from the at-fault person, to pay me the collision deductible. which are these ways? how can i reclaim my money back? since my car insurance doesn’t have any answers for my concerns about this money that i really need. i will appreciate if you can help me with solutions for this problem. thank you so much for your attention. luisa.


    The only way to get your money back is from the at-fault party directly. Your insurance carrier obviously had no luck in getting anything from the person that hit you so your chances of getting anything are going to be slim. Your insurance company is not trying to cheat you out of your deductible, they're not the bad guys in this situation. The bum who was driving without insurance is. You are a victim here and it is very unfortunate that you're suffering because someone else was being irresponsible. Also No Fault is a misleading term. State no Fault laws have to do with injuries that are suffered as a result of an auto accident. It basically means that no one is at fault for injuries until a set dollar amount has been exceeded or the injuries are severe. This is why you have Personal Injury Protection coverage (or Medical Payments). It is supposed to reduce the number of civil torts, but it certainly doesn't seem to be slowing down the ambulance chasers.

    a blue car that is backing out of a parking spot is struck by a white car. the the driver of the white car says that she was looking over at a play ground to the left when she ran into the blue car which she struck on the right side. who is at fault? the one backing up or the one not looking where she was going?


    You did not really say what the white car was doing. If the white car was coming down the isle and the blue car was backing -- then the greater duty is on the backing vehicle. If both cars were backing - they were both at fault. By they way your question is asked....I take it you are the blue car that was backing. As the backing vehicle - you have a duty to yield to cars in the isle. Most likely there will be negligence assigned to you. There is not enough info for me to tell you how much and if negligence will be assigned to the white car.

    Q. My fault? car accident?
    i was recently in a car accident where my car was hit it in the back. it tore the whole bumper off of my car. i stopped at the stop sign and nothing was coming then as i was crossing i saw a jeep head toward my car. i tryed to speed up in order to miss the jeep but they still hit me in the tail. how could it be my fault if the jeep hit my back end of my car? is it really my fault? where could i get help with this?


    Actually, a car already in an intersection has the right of way over a car entering the intersection. If you can get a really shrewd lawyer, he may be able to use this to your advantage.

    i was driving along a shopping centre car park when a car reversed into me. he says it is my fault as he was already backing out when i came along. i am of the opinion that everything must be clear before reversing.


    The person that is reversing/backing out always has to check and double check while doing this so this accident would not be your fault at all............

    Q. How do i get the most money back from a car accident that wrote off my car and was not my fault?
    i have a fairly new, 16 mth old, car that has been rammed from behind and written-off. i was planning to upgrade, but not quite this soon! howcan i maximise the settlement figure offered by my insurer; that will obviously be reimbursed by the insurer of the car that hit me?


    Don't waste time and money with a lawyer unless you are injured. They don't want these type of cases, and the ones that will take it will get a percentage of your settlement. Unless you've done some significant improvements to enhance the value of your car, you're going to have to accept the book value of it. Then good thing is that what insurance companies do is take the value for different books and average them instead of just using one book. They should also give you back the sales tax on the value of the vehicle. If you have a big dispute on what the value is, the two if you can take it to arbitration.

    my son was in a car accident, he was the second car from the front of the stop light, when it turned green, the front car moved so he moved, then suddenly the car across his left moved in front of him thought he had a green light. police came and the report said its a no fault accident, the other car had minor damage on the back right passenger side almost at the end. but our car has a lot. the whole bumper came off from the front. who would be at fault here? how can you tell who is moving/running fast. my son has car insurance.


    Many states are no-fault, no matter who really is. Does your son have insurance? Sometimes it is easier to have you insurance company figure it out.

    Q. Driver backing up car accident?
    i was going straight on a street. all the sudden, a car was backing out from his apartment (right side). i braked immediately and my front bumper was damaged (out of shape/pushed in). there were some scratch marks on the other vehicle's rear bumper. the police refused to write an accident report and asked us to call our insurance companies. who's fault is it?


    You had the right of way, so the person backing is at fault. Just call his insurance company and make a claim for your damage.

    i was backing out in parking lot, and this women was too. she hit my back passenger door on drivers side. i have huge dent and she has no damage. if she is at fault, do i still have to pay deductable to get it fixed? or are we both at fault because both backing up?? i am waiting for insurace to call me back, but just interested if anyone knows. i have never been in accident. thanks


    You're both at fault for unsafe backing and inattention. You both had a duty to see each other and you didnt. You deductible applies if your damage exceeds the deductbile, otherwise you're paying for repairs out of your own pocket and the other insurance will reimburse you at the appropriate %.

    this all happened on easter day. my husband and i was on our way to walmart, just to buy some stuffs that we need for our apartment. i will makeup some random names so you guys won't get confuse with car a, b, c, d. anyways, nestle was driving on stone brook @ richmond ave when she passed over the red light to make a right turn on richmond ave. buttercup was on richmond ave and she saw the green light so she went for it, but out of nowhere nestle was trying to make a right turn onto richmond ave and buttercup hit nestle's car. meanwhile there were two cars behind buttercup. strawberry was driving behind buttercup when he saw nestle began to turn right on richmond ave, and he saw buttercup hit nestle's car and he tried to avoid the accident but he hit buttercup's car by swerving to the left lane. then my husband (kiwi) and i (apple) was going on west on richmond and we were behind strawberry. we (strawberry, buttercup and us) had the green light at the intersection, and we saw nestle ran passed the right light and cause an accident with buttercup's car. thus this cause strawberry to hit buttercup's car. anyhow i was on the passenger seat while kiwi is the driver. kiwi swerved to left lane to avoid the collision but he hit strawberry's car in the back. this all happened in less than 5 minutes. we already have our police reports and the policemen said that it was nestle's fault for causing the accident. we have our lawyer to handle this case for us, but right now we are waiting for nestle's insurance to make up their decision whether they are going to pay us or not. i hope my husband and i win this case. i do not want our insurance to pay for strawberry, nestle, and buttercup's cars. who do you think will win? supposedly nestle's insurance company are still making the final decision and we are waiting for them to give us the answer. nestle's car: minor scratches on the front bumper. buttercup's car: flat tire, on the right side of his car has some seriously damages. strawberry's car: front bumper has some dents and broken lights. our car: front bumper is completely gone, everything inside is ruined. right now we are driving our second car to work/school. it sucks! during the accident kiwi and i have some minor pain on our neck, lower back. we already discussed about that to our lawyer.


    "Passing over a red light" means, running the red light. You can't go right on red, without yielding to everyone who has the gree, and making a full stop, first. Nestle is at fault for the first accident, between Nestle and Buttercup. Not only did she run the red light and make an improper right on red, but she ALSO swerved out of her lane in the process of the turn. Otherwise she wouldn't have hit Buttercup. Then it gets a little tricky, because the answer will vary slightly by state. Strawberry would nominally be at fault for the collision between STrawberry and Buttercup (although if you're behind someone, how do you swerve to the left to avoid them and rear end them?). Kiwi is at fault for rearending Strawberry. See, Strawberry and Kiwi were both tailgating - following too closely. I"m not sure why everyone is swerving left, but it's clearly not working. In some states, Kiwi is going to be at fault for both Strawberry and Buttercup. But a lot will depend on what Buttercup says - Strawberry could very well claim that they DID stop in time, and Kiwi hit them, and pushed them into Buttercup - making KIWI clearly liable for damages all the way through Buttercup's front end. Some states, with multiple cars rearending others, the last guy in, is responsible for ALL the damages. Police do not determine fault. You absolutely need to turn this in to your insurer, as KIWI is going to be at least PARTIALLY at fault, and FULLY at fault for your own damages. So, Nestle's insurance is NOT NOT NOT going to pay for your car. Period. But YOU, or your insurer, will be paying for, AT LEAST, the damage to the rear end of Strawberry's car, and your car. And the Bodily Injury to strawerry's passengers. And depending on what Strawberry and Buttercup claim, possibly the damage to Strawberry's front end, and the portion of Buttercup's car that Strawberry's hit, and some of the injuries to the people in Buttercup's car, and maybe some of the injuries to people in Nestle's car, as well. I hope you have really high liability limits. You're best off firing your lawyer. YOUR injures, you will only get paid, by YOUR insurance, as YOU are at fault for them. Fully. So, having a lawyer, you're going to give him 40% of what you can collect off of YOUR policy. You don't need a lawyer to collect under your own policy. You're giving away money to the lawyer, for NOTHING.
