    i was done backing out of my parking spot and ready to shift gears to 'drive' when i turn to my left side to check if there were any pedestrians or cars, and suddenly i see someone's bumper like in my face. i had no reaction time to honk and the guy hit into the driver's side door. i was already waaaay out of my parking spot, my car was straight and ready to go forward. so is he at fault? will my insurance go up? location: my high school parking lot.


    you were stationary, he crashed into you, it's his fault.

    i was in the space to the right of the other driver. we were both facing out, having backed into the stalls. we both started to roll, i saw him and stopped. he didn't see me and caught my front end in his door when he turned. he says i was moving and ran into him. i never left the actual parking spot and was stopped when he struck my vehicle. who is really at fault? ps. this is in washington state.


    In most places it doesn't matter. The cops won't even come look at this in lots of places. You use your insurance and he uses his. It probably isn't even worth trying to take him to small claims.

    i backed out the car from the parking spot and i put the car in “drive” and my car was straight and ready to go, and a black toyota came from nowhere hit the rear of my buick century. whose fault is the accident?


    When you're backing you have the duty to yield the right of way to vehicles in the aisle. However, you had already completed backing, but the vehicle into drive and were about ready to pull forward. You weren't backing, yes you did but at the time you weren't. The guy driving down the aisle has the duty to pay proper attention and to take the last clear chance to avoid an accident. He obviously wasn't paying attention since he had plenty of opportunity to see you pull out and then stop and then put the vehicle into gear. He was the striking vehicle which gave him the last chance to avoid the accident and he could have by simply stopping if he was paying attention but he didn't.

    Q. As per washington rules of road when backing out of parking always your fault?
    the insurance company said it is always fault of a driver who is backing out from parking lot, is this true? my friend was backing out of parking space at speed like 3-5 miles an hour and dump truck was blocking his way and he did not notice it, the dump truck driver was not in the truck as he was in the back of truck trying to dump garbage. so while backing out from his parking spot, my friend car's right side tail light assembly was broken and there was no other damage to his car neither any damage on dump truck still insurance company raised his premium because they decided it is at fault accident as per wa state law. is it true when you are backing out it is always your fault? irrelevant something was blocking your way? can you give me internet link where i can read about this law?


    Yes it is an at fault accident. There is no state law that says you are automatically at fault because you were backing. But many laws place the greater duty of care on the backing car. In your friends case, the dump truck was a parked/unoccupied vehicle. It was a hazard that was there to be seen. If the dump truck was blocking the way - that gives your friend the right to have the dump truck towed....not hit it. Therefore, your friend is at fault for hitting a fixed object. There is no "but he should not have been there for me to hit" defense.

    i was driving along in the parking lot looking stright ahead when all the sudden i was backed into by a car backing out of parking space.my damage is from the the door back to quarter panel. she clearly hit me.im still waiting for insurance company to get back to me.the other drivers trying to claim that is a one-way.there are no signs or arrows on pavment saying its a one way.on the same strip there is an entrance and an exit on to road way.the parking lot is private.no police report.although i talked to local cop and he said its not a one way cause thers no markings .the parking spots are angled.there is enough room for for three cars lined side by side. whos at fault here? she clearly hit me from the back of my door back. i wouldnt be able to see her anyway i took pictures of parking lot and traffic flow.in a matter of five minutes i got 8 people driving the same way i was driving.theres arows everywhere else in parking lot except where i was


    the person who backed into you is at fault. regardless if it is a one way or not that person backed into the side of yuor car they should have been looking when they backed out. if it is to go to court make sure you have pics of lot parking lot and statements proving that it is not a one way.

    i just backed up into somebody who was parked but not in a parking spot. we didn't exchange insurance. i gave them my name an phone number, but now the lady is saying that she is taking it to the dealership instead of somewhere else? i don't have insurance, and we have not reported it. i know dumb for not having insurance, it just expired 3 days ago- and i haven't had a chance to get a new one. any advice as far as reporting it, and so on? i already got insurance, and no there was no police report. she kind of seems to want to do it under the table, which i guess is legal


    Depending on the State you are in Laws are different. If you ,Nor the other person Called the Police and Filed a report of Non Injury accident. And she drove off with just your name and number. Now she has to sue you for payment of repairs to her vehicle. No report? No witnesses ? Cancel your phone number. Get phone with different company. Or You have to step up knowing you were in the wrong and pay out of your pocket. The person that was hit, should never just drive away without insurance information and full name address and phone number. And or Police report that can be picked up the next day at the station after filed by reporting officer. In Oklahoma Police won't come In California Police won't come. In Texas Police will come. ( They know 60% of people don't have proper insurance or Tags so they like to issue reports after.... Tickets, Fines and Impound Cars ) In Dallas County you would have gotten Ticket for no insurance, Car impounded and fines to go with the impound.

    Q. Who is at fault in private parking lot accident?
    i was parked facing foward in a parking spot. to the driver side there is a slight bend in which obscures vision of vehicles park or passing through. i look both ways and ther slowly pull out. i get about a about half way out, when a vehicle comes around the bend and hits me on my driver side in front of my left tire. the driver must have been speeding at least 25mph (based on collision repair personel). the company who did an repair esimate on my vehicle said, the my vehicle may be tottaled due to frame damages. i had no time at all to even think to back up. the police would not come due to it being private property. although an loss prevention associate for the retail store took a statement from the the driver, in which she stated she wasn't looking, and that she was looking at the building instead. she also said it was her first time in this parking lot. a felt i had the right away under these circumstances. she could have avoided hitting me if she had been looking. ins. blames me.


    Because the police will not deal with private property accidents, there is no fault assigned by them. Your insurance company can review the facts, and decide accordingly, but ultimatly, it's considered a "no-fault" accident.

    setting: in a small apartment complex parking lot person 1 is in car preparing to reverse out of parking spot. person 2 is driving at approximately 15 mph through the parking lot and doesn't see anyone with reverse lights on. person 2 proceeds to look quickly at a cell phone which is placed in a cup holder. at that moment, looks up only to find a car that has already reversed in front of the vehicle. person 2 attempts to turn to miss the car even though person 2 was close the vehicle. damages: busted back light of person 1''s vehicle. dent to back of person 1's vehicle. some front dents in person 2's vehicle. (this story was told to me by person 2)


    They are both at fault, but person 1 would be held responsible by the insurance company, because that person backed out into a line of traffic. At the same time, person 2 was not driving safely because person 2 looked at their cell phone while driving - and that is illegal in many states and provinces. If they are lucky, the insurance will split the blame 50/50 but there is a lesson for both of them in this incident. Luckily, no one was injured.

    got into a small parking lot accident and i think it is a even fault 50 50. i live in nj and they dont say whose fault, instead it goes by percentage. i was backing out of a parking spot and it is when at the middle of the road, a suv which parked behind me also back out 2. the suv hit me and caused minor damages. so who's fault? i back out first but we both moved our cars so it wont be in the moddle of the road. this is direction given by police dispatcher.


    Cops determine fault for traffic offenses and Insurance companies determine fault for damage repair. Me or you or uncle Joe cannot determine fault

    a blue car that is backing out of a parking spot is struck by a white car. the the driver of the white car says that she was looking over at a play ground to the left when she ran into the blue car which she struck on the right side. who is at fault? the one backing up or the one not looking where she was going?


    You did not really say what the white car was doing. If the white car was coming down the isle and the blue car was backing -- then the greater duty is on the backing vehicle. If both cars were backing - they were both at fault. By they way your question is asked....I take it you are the blue car that was backing. As the backing vehicle - you have a duty to yield to cars in the isle. Most likely there will be negligence assigned to you. There is not enough info for me to tell you how much and if negligence will be assigned to the white car.
