Your best option is to have your insurance company do the fighting for you. That is why you pay them premiums. Another option is to sue her in small claims court

i was backing up the other morning, looked both ways and saw nobody was coming. i have back-up sensors as well and there was no indication that anybody was coming. i started to back out, and next thing i know, the sensors were going off like crazy. my left bumper hit a car coming down the road. neither of us saw one another (she stated) and there was no honk or anything. we exchanged information and went on our way. now, she wants to send me her estimates, claiming it was my fault. who is at fault in parking lot accidents? everywhere i have looked said there are "no fault" accidents in parking lots, but i am just curious because neither of us (as she indicated as well) have any idea how this happened, it just happened and we did not see one another. please advise. :)

If you were backing out of a parking spot and the other driver was driving through the parking lot then it is your fault, no fault would apply if you were both backing out of parking spaces at the same time and hit each other. Allow the insurance adjusters to divide this out , 9 times out of 10 it is a 50/50 decision where each pays their own damages

alright, so i was slowly driving along the lane through the parking lot, and a lady backed into the side of my car, damaging the right rear door and very edge of the quarter panel by the wheel well. she claims that i "indicated to her that i was going to yield" and said i swerved my car to get out of the way of her backing out. i didn't see her at all, and certainly didn't move to get out of the way. given the position of the damage on my car, and the situation, who is at fault? thanks

the party backing has the greater duty to look to the rear. Also points of impact would indicate you were already complete behind her and in what we call the "impact zone". No matter what the impact could not have been avoided.

MI is a little "screwed up": "Michigan's "No Fault" statute was designed to limit litigation, by shifting the risk of certain losses from automobile accidents to the owner of the vehicle. If you choose not to insure your vehicle for collision damage, even if you are 100% innocent of blame in an accident, if the other driver is properly insured your ability to recover from the other driver for property damage is limited to a few hundred dollars under the mini-tort statute, MCL 600.3135(3)(e). (This is why the statute is called a "No Fault" statute – you are responsible for certain costs regardless of who is at fault.)" In MI, the other party would certainly have a majority of the fault but if the area you parked in is marked as no parking because it's a dangerous area to be parked, you could share some liability. But as mentioned above, that is pretty much moot.

The driver who hit you. You were parked. If there wasn't enough room, he shouldn't have tried to park there.

the person who backed into you is at fault. regardless if it is a one way or not that person backed into the side of yuor car they should have been looking when they backed out. if it is to go to court make sure you have pics of lot parking lot and statements proving that it is not a one way.

i was in the space to the right of the other driver. we were both facing out, having backed into the stalls. we both started to roll, i saw him and stopped. he didn't see me and caught my front end in his door when he turned. he says i was moving and ran into him. i never left the actual parking spot and was stopped when he struck my vehicle. who is really at fault? ps. this is in washington state.

In most places it doesn't matter. The cops won't even come look at this in lots of places. You use your insurance and he uses his. It probably isn't even worth trying to take him to small claims.
