    Parking lot accidents are no fault and you don`t lose points. Your insurance is usually not affected because charges are not laid.

    Q. My fiance was ruled at fault in accident, but it wasn't his fault.. nc?
    scenario: he was pulled out of a fast food place towards a light, he saw a gap between 2 oncoming vehicles in the crazy traffic. as the first car was passing him, he began to pull out behind him. the car, which was going a decent speed towards the light, then decided to cruise into (without slowing down) the same parking lot my fiance was exiting, with no turn signal. my fiance ended up hitting his rear tire. he got out to make sure everyone was alright, they were. the man sustained a small dent and a little paint damage which he said he wasn't worried about, but his tire was bent in a little. he said that was all he cared about. he was mechanically inclined and would do the work at home if it was something simple. it turned out to be less than $200 in parts and my fiance was going to pay for them as they had agreed. i had my fiance call the police so this guy couldn't exaggerate everything and to show that he wasn't at fault. the cop said my fiance was at fault since he hit this man. well, they were supposed to meet so my fiance could pay him, he just wants it over, and the guy calls today and says he is going to file a claim through the insurance. here is the issue: we are house sitting for my mother for a year and he was driving her vehicle, with her insurance. he wasn't covered. this guy would have to sue her insurance to settle and once my mother gets wind of this, well, let's just say we are going to be moving somewhere else, and we have 3 kids and basically no money. a few thousand, but not enough to uproot right now. we would have to get another vehicle and 3 months rent ect together. point is, this accident was not his fault, but since it's hard to prove the other guy was driving aimlessly with no signaling, it's hard to prove. what can we do? we had no choice but to call the police. my fiance was not at fault and, yes, they had an "agreement" just as they had yesterday evening and now the guy is going to go through the insurance anyways. he would have done the same except there wouldn't be any documentation at the time. the thing that screwed it all up was that my fiance first explained it to me as that the other guy pulled out in front of him. he didn't fully elaborate. plus, he didn't know at the time the other guy was a marine... so the cop would favor him, obviously. he didn't hit the guy from just pulling out on him, he was turned left across a two lane road. he pulled into the first lane, about to pull into the other behind the guy and he just cruised into the parking lot with no signal and no braking. more or less, he side swiped the front end of the van. he even turned too early for the entrance. he isn't covered on my mother's insurance. only she is. it will raise her rates and force her to add him to her policy. even though he won't be driving the van. he is/was about to get his transmission repaired so he could drive his vehicle. oh, and the light was red. he was clear across the first lane to get over. the other guy was traveling towards the light with no way to see that he was turning, at a decent speed, hadn't even brake coming towards the light yet. my fiance went to pull out behind him and he swerved into the parking lot with no signal or braking. how was he supposed to know he would turn?


    OK, I see the exaggerated drama and the infinite useless details of a LOSER! First of all you and your "fiancee" are irresponsible wackos. I see at least five wrong decisions that you both have made and are trying to justify. The mother's car was not yours to drive. If it was she would have insured it to cover you and your husband. Second of all, that is why responsible people have insurance because unless you have eye witnesses, it is one person's word against the other. You end up paying out more than insurance would have cost. When you decide to travel on a different path than the rest of society, you reap what you sow. Three kids, basically homeless, unmarried, unauthorized use of a vehicle, squatting at mother's house, you sound like trouble just looking for a place to happen. Bite the bullet, clean up your acts and become responsible members of society. Stop trying to jailhouse lawyer your way through life.

    Q. Parking lot accident 10/29 - what can i do?
    i was driving. my mother was in the passenger seat. we were in a post office parking lot and were getting ready to leave. i shifted into reverse, looked left, right and behind me and traffic was clear. my mother, also looked left, right and behind us to make sure nobody was coming. i started to back out and was all the way out of my parking space. i stopped the car and when i was reaching down to shift into forward we felt a bump. i looked behind me and a white ford taurus had backed into our right rear bumper/tire. it was clearly the side of our vehicle that she hit and she pulled back into her parking space. my mom and i got out of the car to look at the damage and a piece of my bumper (the plastic part under the bumper/support) had broken off and was on the ground. my bumper now has a huge dimple in it. i moved the car back into the parking space to keep from disrupting traffic. my mother called the police. when the police got there we each gave him our sides of the story. mine being everything above. the lady that hit us was clearly in a hurry and said she had looked to her right (because its a one way parking lot) and began to back up when she felt a bump. she didn't have her registration with her and the police officer didn't give her a ticket. to my knowledge it is a state law (nc) that you must have your valid registration with you at all times. he didn't give her a ticket. we did exchange insurance information, and filed a claim with her insurance company(allstate). she didn't file a claim because she didn't have any damage to her car. i asked for a rental car when i talked to the allstate agent, and 3 hours later we received a call from enterprise that allstate had booked us a car and when and where they should drop the car off to us. 11/2 - a different allstate agent called us back to get our recorded side of the story and whatnot. after we gave her our perspective of the accident she told us that fault could not be determined because my side of the story and the lady that hit us side of the story were contradicting each-other. she also apologized that the call made by them for the rental car was an uncalled for action and that it wasn't the correct action because they hadn't determined fault yet... while we were thinking that they had determined that it was the lady fault and not ours and that she was going to pay for the repairs to our car (1,000+). she also told us that the police report said we were both 'inattentive' and when we received a copy of the report the picture was wrong too. we called the police officer and he was extremely rude to us in his answers to our questions about the police report. we are having allstate come out and look at our car thursday even though the agent said that probably wouldn't change her decision. is there anything we can do to prove that it was her fault? should we take legal action? what would you do?


    The biggest problem you have is that NC is a pure comparative negligence state. That means if you are even 1% at-fault for the accident you can't collect from the other drivers insurance. There are very few parking lot accidents where one driver is 100% at-fault and the other is 0%. You are going to have a very tough time proving that you weren't at least 1% at-fault. The only thing you can do is run the claim through your own insurance if you collision coverage. Good Luck

    Q. Parking lot accident / fender bender in north carolina - should we filed a claim?
    my wife was in a parking lot in her lexus rx300 suv and started to back up. she stopped, established a position, and was about to go from reverse to drive when another suv backed into her. she sustained a pretty big dent to her side in the back where the rear bumper is. the other driver had practically no damage but a few scratches to the dead center of his rear bumper. if i had to guess, the damage might be between $1,000 and $1,500. we have a $1,000 deductible with usaa. the cop said each person was responsible for his or her damage because the accident occurred in a parking lot in north carolina. does anybody know the nc law regarding this? from the looks of it, he is more at fault than my wife, as indicated by the damage and pictures. if i file this with my insurance provider, will i have to pay the deductible? don't the insurance companies determine who is at fault when it comes to insurance claims? please help!


    Regardless, you will pay your deductable, that's the point of a deductable. So it's probably not worth the trouble. If you are in Reverse you are 100% at fault. If both parties are in reverse you are each 50% at fault. Accidents in parking lots are also 50% fault because they are usually too hard to determine who was more at fault based on driving rules. Damage to your vehicle doesn't indicate fault. If a car runs into a transport truck, the truck will have no damage, the car will have lots. The car can still be at fault though. Result will be, you pay your deductable, you get 500 bucks from your insurance company and your rates go up for the next 5 years
