I had a car accident in the parking lot. my car was parked within a marked diagonal lines accordingly, and? this woman (in her 50's) was too lazy to park it properly. she parked like a parallel on the right side of my car. when i backed my car and did not see her left rear bumper crossed my zone, my right rear bumped into her left rear metal bumper. my 06 lexus' bumper totally messed up on the right. her pickup was a 1985 toyota, and it sustained a minor scratch on the metal bumper. i could not see her pickup's bumper had blocked my right bumper on the rear-view mirror, on the passenger's side. her pickup was parked and unoccupied when i bumped. had she parked her car properly in the marked diagonal lines like everyone, this accident wouldn't have happened. she verbally admitted her fault and was willing to pay for my damage. the insurance company of each side is investigating. could you please tell me who is at fault in this accident? thank you!!

Car accident! whos fault? there is a car backing out of a parking lot and hits another car but the car is not suppose there bc its a fire zone ..and theres someone in the car.....who's fault would it be?...the car in the fire zone stops so the car would come out and then hits the car. who's fault?

Car accident... who is at fault? ok, i was turning left into a parking lot when a car that was going about 45 mph in a 25 zone hit me in the passenger's side...the police officer told that even though he was speeding i was at fault because i was the 1 that turned... how is that possible? i didn't even see him because he came at me so fast. he got away with just a broken headlight while the right side of my car is totally ruined, shouldn't he be the 1 pay for the damage to my car?
you failed to yield right of way before turning left, regardless of whether or not the person you failed to yield to was speeding and regardless of why you failed to yield, bottom line is you failed to yield

Car accident what should i do? hi, i got into a car accident in a parking lot. i was driving my car in a lot looking for a space on my left. there was none so i proceded to make a u turn since there was no other way to get out. i could not complete the u turn because some car parked in the fire zone. so at this point my car is facing the store, the illegally parked car is facing my passnger side. so my only option is to move back and do a k-turn. i was trying to but someone else was backing up from the place i was originally trying to park. i honked about 5-6 times, but she kept going and eventually hit me. the cop came (at this time the car facing my pssngr side left) and automatically said that i was parking in a fire zone and that it was partly my fault. i tried to tell him the truth but he kept insisting that i was bs'ing him and that i should "man up"- rude much.... i continued to explain the situation but he would not listem and said that if i dont admit to parking illegally he would increase the penalty making me more at fault. at that point i had no choice but to tell him what he wanted to hear...damn haledon nj cops... what should i do. can i fight this or should i just pay the ticket. <---"guilty until proven innocent"
Sure you can fight it. It will be you word against the cops but take in plenty of photos of the area and mark where all the cars were.

at the intersection of xx and yy, the light was green so i continued to go straight.
the signal light turns yellow. unexpectedly, traffic forms and the cars ahead of me stop. hence, i am stuck in the middle of the intersection.
note: this intersection is a camera zone (cars that pass on a red light will be fined).
i immediately decide to change lanes to the left, because if the light turns red and i continue to stay in the middle of the intersection, (1) i will cause traffic for the cars passing on yy, and (2) my photo will be captured and i will be fined for “crossing” on a red light.
note: the lane to my right is backed up by traffic, but the lane to my left is free for many spaces ahead of me.
by this time, the signal light turns red. thus, i look over my left shoulder, and after verifying 100% that no car is on the lane to my left, i signal and am changing lanes when all of a sudden, a car appears in the left lane and the front left portion of my car collides with the rear right portion of his car. i follow him to the nearest parking lot, where we exchange our information.
possibility: there was no car coming from the lane to my left when i looked over my left shoulder. but a car was in my left lane when i changed lanes. thus, he was behind me, and upon seeing the light turn yellow, he too changed lanes.

 Q. Car accident lawsuit? i was tboned on my passenger side about a week ago. i have hidden fractures in my left wrist and knee, severe neck and lower back pain. the cop said he couldnt determine fault. the woman said her husband was a police officer and everything will be my fault. when i got the police report (after the cop talked to the lady's husband) it said it was my fault and i was the striking vehicle (even though i have no front end damage but passenger side damage) when i went to talk to the officer he said it doesnt matter how he wrote it. my insurance company said it was my fault because even though i was t boned the driver on the right has the "right of way" not even one week after the accident the mall security called me and said they have footage of the entire accident. the woman ran a stop sign, was clearly speeding in a 25 m.p.h. zone, and didnt even brake when she hit my car. also, my front end was already in the parking lot when she hit me. should i sue? how much? this is not a joke. thanks
insurance company is aware of the tape. i can only have a lawyer supoena the tape if we pursue the lawsuit.
i didnt initially want to get internal affairs involved but the cop should not have skewed the report in the first place. i am a fresh criminal justice college graduate and i feel like its my civil duty to pursue this lawsuit because had it been a nrmal citizen without criminal justice knowledge the justice system would have railroaded them. i have already thought about contacting news stations because i know this story will sell!! the important thing is no one lost a life. however, i have been put through the ringer and having knowledge of criminal justice has helped me tremedously
PURSUE the Lawsuit.
Get the tape. Sue the person that hit you (for the obvious reason). Sue the officer that wrote the report if possible (falsifying a report). Sue the city where that officer works (for hiring a crooked cop).
Good Luck collecting any settlement. The Judge probably knows these scum and you will have a hard time getting a fair settlement. And after you will always have police harrassing you. But you got a great case with the video tape.

As for the car on the right having right of way. I say BULL - your tape will show who had right of way.
P.S I would get a lawyer simply because your dealing with the police at this point. They can make life hell for you if you get on their bad side. And if you pursue legal action against them be prepared for some mafia type retaliation. Document everything and every action by any police officer that you encounter. Remember they stick together. Even if you win you will lose. So you got to be careful to do things within the law.
The one bad thing here is that when you go against someone who has the police on their side, how do we know the lady wasn't drunk driving or on drugs. You dont. They got the cops on their side.

Legal thought-question? sometimes i like to think of tricky legal problems and what the solution or outcome might be. today i thought of an interesting traffic situation. suppose a car is speeding 15 over in a school zone. a cop, sitting in his car on a perpendicular street sees this and turns on his lights and begins his pursuit. by the time he rounds the corner he sees that the speeder has hit a car that pulled out of the school parking lot. the car pulling out of the lot did not see the speeding car, but would have had the other car not been speeding i.e. the car in the parking lot had a restricted line of sight such that it would have had enough time to safely execute the turn assuming that no cars were speeding. who would be at fault for the accident? keep in mind the cop only saw the aftermath of the accident.
no, this did not really happen and i am not looking for free legal advice, haha.

You cannot turn onto a street unless it is clear. I had a similar situation actually take place, and I was the one in the speeding car.
I was in the left lane on a two lane per direction road. About 80 ft. ahead of me was a van in the right lane. We are approaching an exit from a shopping center parking lot on the right side of the road and I see a car waiting to make a left turn. I can see the car, but I can also tell that their view of me is obstructed by the van. I take my foot off the gas and hope that they don't try to turn directly after the van passes. They check to the right as the van passed and pull out directly in front of me. I t-bone their car.
It was a young girl driving and she jumps out and tells me that it was my fault because I was going way too fast. I tell her to wait and see what the cop says.
When the police arrived she immediately tells them how it was all my fault. The cops response before she even finished her story, "He could have been going 100mph, you can't enter the roadway unless it's clear. It was your fault."

Car accident!!? ok, my mom was picking me up after school today and she parked in like the school zone. then we were pulling out of the driveway and there was a car in front of us and there was a lot of space, so my mom just reversed the car and went forward again when all of the sudden, there was a loud crash. another car just came up and lifted the front car bumper and it fell on the ground. i was embarassed cuz everyone was crowding around and i was really depressed. i got out and went to the other car and said what just happened. she was an indian woman and shes just like, its not my fault its not my fault" which got me mad! and we called the rcmp and our insurance and they said its actually our fault. and we have to fucking pay 300 dollars for the damage and 167 dollars or more for the violation ticket. someone say something good
Well, I know it probably won't help too much, but at least no one got hurt.
And don't be embarassed about this. Moms do crazy things everyday; we just try to make sure our kids aren't around to witness them. :-)
Look on the bright side: You now have a legitimate pass on your first ticket. Afterall, if I was your mom, I'd have to say, "Been there, done that. What can I say except, this is your one and only pass; don't do it again."
And because moms sometimes forget, if you ever find yourself in a similar situation to your mom's, a gentle reminder may (or may not...I don't know your mom) lessen your punishment.
p.s. next time mom is driving, be alert...:-)
