Q. Car accident in a parking lot. who's at fault? earlier this morning, i was leaving school to head home for the day. our parking stalls are vertical, not slanted, so you can either back out or pull forward to get out. if you pull forward, you have to turn left to get to the exit of the parking lot. i pulled completely out of my stall into aisle and started to make that left turn when i noticed that a car was coming on the other side of the parking stalls. i slowed down to a stop as i turned, and the driver hit me. when i got his side of the story, he said that he slid on a patch of ice. the damage to my car was dramatic. i got out to inspect it and i saw that my bumper is cracked, the hood of my car is jammed and misaligned, my left turn signal doesn't work under my headlight and is acting up on the left side of my car, my headlight is cracked, and the driver's side has a lot of paint damage. the car of the other driver has chipped paint. that's it. so who would be at fault?

i was already in the aisle when the accident happened. it was a two-way aisle. and he was coming from my left as i was turning. i was at a complete stop.

You were stopped, the other car was sliding on ice -- driver looses control of his vehicle is usually at fault .
Don't worry about "right of way" -- unless the other guy was going too fast or not paying attention he should be able to see you in time to stop.
Don't worry about what somebody says "the law" is -- unless he's a specialized lawyer licensed to practice in your city, he could be mistaken.


Q. No fault insurance, car/elderly lady accident in parking lot? yesterday, an elderly lady (age 90, but still spry) got out of her son's car, and almost got to the door of walmart. a car with a young girl driving came along the lane by the front door, speeding, not watching where she was going. she hit the old lady hard enough so that the lady sat down very hard on the pavement. whump!!!
the old lady refused to let anyone call an ambulance for her because she didn't feel any bones were broken. she'd had a broken bone before, and knows how that feels. and... she didn't want to pay for an ambulance. fixed income, and all that.
i thought that the girl's car insurance would have to pay for the ambulance, since the girl clearly hit the lady.
we live in michigan, which, last time i looked, was a "no fault" insurance state.
would the cost of an ambulance come off the girl's insurance, or would it come off the old lady's insurance because of the no fault thing? and, if it is the old lady's insurance, would her rates then go up because of the ambulance expense?
the old lady simply got a ride home, where she is suffering today. getting by with tylinol and stuff. i think she should have at least gone to the er for a checkup.
also, is the girl going to get off scott free? i don't think that anyone called the police or anything? i'd like to see the girl have to pay for the lady's pain and suffering. maybe even have ler license taken away for a while.

the young girl's insurance would have paid, and the old lady could sue in a civil court. no speeding ticket can be given to the girl because there is no proof she was speeding because cops don't run radar on private property. the police would have come and made an accident report and filed it at the PD in case the old lady wanted to take it to her ins company/lawyer. You can't call the police and have the girl charged. The old lady would be the one to press charges.

the accident occurred when both cars were pulling out of opposite parking spaces and clipped each other. one driver turned the claim into their insurance and their total damage estimated was just over $1,100. the other party took care of their own damage and filed no claims.

Long ago I handled AZ auto cases and can't recall the rule of negligence in AZ. However, there is no such thing as a "no fault" accident. That term applies to PIP/No-Fault medical benefits which is not applicable to your property damage case. I suggest you submit your claim to the other partie's carrier. Provided the negligence rules in AZ are either "pure comparative" or "modified comparative 49% at worst you should be able to recover at least 50% of your damages from the other party's insurance carrier. I presume there were no independent witnesses.

I had a car accident in the parking lot. my car was parked within a marked diagonal lines accordingly, and? this woman (in her 50's) was too lazy to park it properly. she parked like a parallel on the right side of my car. when i backed my car and did not see her left rear bumper crossed my zone, my right rear bumped into her left rear metal bumper. my 06 lexus' bumper totally messed up on the right. her pickup was a 1985 toyota, and it sustained a minor scratch on the metal bumper. i could not see her pickup's bumper had blocked my right bumper on the rear-view mirror, on the passenger's side. her pickup was parked and unoccupied when i bumped. had she parked her car properly in the marked diagonal lines like everyone, this accident wouldn't have happened. she verbally admitted her fault and was willing to pay for my damage. the insurance company of each side is investigating. could you please tell me who is at fault in this accident? thank you!!

Dude. Who was driving the car? What if a dog or child had wandered into your parking space? Who would be responsible for backing into the obstruction then?

Parking lot accident, who's fault(nj)? allrite so i was involved in a car accident(in new jersey), who's fault is it if i am going straight and the car gets of its parking(with the front of the car facing mine) and hits my car. with his right bumper being hit and my back driver side door being hit.

Parking lot accident - no fault of mine but there are no witnesses and the woman has changed her story? i was parked in a lot outside a starbucks and drinking coffee when a woman backed into my car damaging the fender. at that point in time she offered to pay for the damages and profusely apologized. however, once it went to the insurance company, she changed her story and said both of us were backing up. i do not have any witnesses. what are my options at this point in time ?
Your best option is to have your insurance company do the fighting for you. That is why you pay them premiums. Another option is to sue her in small claims court
