    Parking lot accidents are no fault and you don`t lose points. Your insurance is usually not affected because charges are not laid.

    Q. Who's fault is it when two people are backing out of thier car in a parking lot and hit rear to rear?
    ok so here is what happened. i was backing out of my schools parking lot and i admit i didn't look before backing up when i felt like i hit something me and this other guy hit right in the middle of the aisle bumper to bumper he never hit his horn so i know he wasn't paying attention either. he said he was looking but no one would just keep going and hit there car are they would have honked or somthing so i know he didn't look as well so we both looked at the cars and his bumper was in but somthing that could easily be fixed and mine was not that bad. now we are young so i know our insurance is going to go up so we left it that he was going to take care of his car and me of mine we only exchanged numbers because it wasn't anything serious so i decided to not report mine to insurance because i can live with a little dent in my car. he did who's fault was it? and i've heard that in a situation like that both are at fault and both pay for thier own things?


    Depends on the state. Some will make you each pay your own repairs. Some will make you split both bills 50/50.

    Q. Whose at fault?? car hit me while i was pulling & halfway out of a parking space.?
    i was tightly parallel parked btwn 2 cars, on a one lane street - a few spaces up from an intersection w/ a stop sign. i put my turn signal on, pulled back straight to make room to turn. i then looked behind me to check for oncoming traffic- seeing the car in question was stopped at the stop sign. i turned my wheel and slowly pulled forward at a diagnol - now looking forward to make sure i was clearing the car parked in front of me... suddenly i was hit by the previously stopped car -which had driven forward straight into the front corner of my car. now, i know its my responsibility to "yeild" to oncoming traffic, make sure the lane is clear before i pull out - but it was-- i did check and saw the car was stopped at the stop sign, traffic was not moving towards me as i moved out; i was halfway out of the spot when he hit me. his wife also stated " you were out too far" which indicates to me that he saw my car turned out onto the street and decided to move forward anyway, thinking he could fit through & move past me. if he was looking he had to have seen me pulling out --- and it wasn't possible for me to continue looking back as i turned out onto the street because i had to make sure i had enough space to manuever around the parked car in front of me. everything i've found says the car pulling out is always at fault--- but if signaled , looked to check & the traffic behind me was stopped when i began to move forward , don't i have to trust they're looking ahead & will wait to go until i finish coming out? what else could/should i have done??


    You are at fault. You have to yield to oncoming traffic at all times while you are pulling into traffic not only when you start to pull out. The other vehicle did not in any way, shape or form have to wait for you or slow down so you had the time to pull out in front of him. Not only are you at fault but even if there were no accident and a cop were to have seen you pulling out and see another vehicle even have to step on his breaks for a half a second to give you time to pull out, the officer would have every right to site you because you did not yield. Yield does not mean beat the guy that is coming up behind you. Sorry.

    Q. A car was reversing and hit my car? who is at fault?
    i was in my high school parking lot, and i did a pull through park that morning. [where you find a parking spot, and the one in front of you is open, so you take that one.] i was driving forward after school, exiting my parking spot, and while i was in the lane/aisle/don't know what to call it the car in front of me in the row in front of me was backing out. i slammed on my breaks because if i kept going they would have hit me on the side. i panicked, and honked my horn [ i was still stopped]. i frantically tried to put my car in reverse, but they hit me before i got the chance. i was completely stopped, and they hit me. they obviously were not paying attention that someone was right behind them. so who is at fault? her for inattentive driving? i warned her to stop, but she failed to do so. she also had a car full of people, so they were a distraction. or am i at fault? i heard that pull through parking is illegal in some places. i have never heard of it being illegal at my school. they have never talked about it in driver's ed, nor do they give out tickets for pull through parking. if they decide i am at fault for illegal parking, should i fight it? if it was illegal shouldn't they have given tickets out to cars parked in that fashion? if they didn't how would anyone know it was illegal? so all in all, who is at fault? thanks. i got to a public high school. and the damage to my car is roughly $900.00 to replace my front bumper. there are camera's in my school parking lot so it is on camera. i wasn't exiting the parking lot the wrong way. i was going down the correct way.


    She is. Even if your pull-through parking is against your school rules (I seriously doubt its a law anywhere, but have seen it as a school parking rule at high school and in college) she still hit your car. End of story.

    Q. Car turned into my car which was backing up. fault?
    i was in my car in my universities parking lot and was preparing to back up. i put the car in reverse so the lights were on, and i started backing up to the left, into the stall left of me since three stalls to the left were also empty so i had room, so that i would be able to see to my right to see when i could back up. i let one car pass and then i continued to back up to the right. that car that just passed me decided at this point to take a tight right turn (which the driver admitted to) into the path of my vehicle which was backing up, obviously attempting to get into that parking spot (for reasons unknown she chose that spot where my car was backing up, instead of the other many available). so we collided, and she honked after the fact to try to make it look like she was standing still which she wasn't. there was nothing but a small bit of paint removed from the left side of my rear bumper, but her car got hit on the right back seat door causing an ugly dent. who is at fault? well the thing is though she said after she made that tight right and realized she didn't have enough room, she started backing up so obviously we collided when we were both backing up? so shouldn't she be at equal fault if she is also backing up?


    You are. When you back into a person while backing out of a parking space, you are at fault. If the other car had been also backing out of a space when you collided then the blame would have been shared 50/50. However the person driving in to park always has the right of way over the person who is backing out of a parking spot.

    Q. While waiting on a red traffic signal, a car hit me at my rear bumper, whose fault is that?
    i was forth or fifth on a lane while waiting for my turn to move ahead on a red signal, before i (start driving) do so as i mentioned cars before me to move ahead, a car from my back hit my bumper and its not intact, its hanging thought its safe to drive but later on i started having stiffness on my back and mild back pain. first i tried to settle it with the other driver but she had a doubt that in future i might bother her for more money and we decided to report the incidence to the police station. my intention was to protect her from insurance company by not claiming, i am(not 100% sure) aware that most probably its her fault and unnecessarily it would increase her premium cost next year when her renewal comes but only because of her rigidness and not trusting my self we ended up reporting to the police station. now, as i mentioned, i am 100% not sure whose fault is that? is that anyway put me at fault? let me know. thank you, manish patel


    You were legally stopped at a stop light, and she rear ended you. She is 100 percent in the wrong, no question. If she couldn't stop in time, she was following too close. If she wasn't paying attention, that's her fault. Even if there weren't a presumption that the person who hits someone in the rear is at fault, she DEFINITELY is here. There are conceivable situations in which the person who gets rear ended could be the one at fault, but this is NOT one of them. DO NOT protect someone else by not making a claim. You WILL end up getting screwed by it somehow.

    Q. A car backed up from a parking space and hit my car while i was driving very slow. who is at fault ?
    my brand new honda accord hit by a car backing up from the parking lot. i was driving through my parking lot and a car from the parking space backed up and hit my car on the drivers side and i got some dents and scratches on my brand new car. i was driving very slow. but i am not sure whether the car hit me was fast or slow. i have $500 deductible in my auto insurance. so can you tell me how this works. am i suppose to pay all the deductibles ? who is at fault in this one and if the other person found guilty in this one that they suppose to pay the deductibles. how do the insurance companies decide who is at fault ? please advice


    Usually, the person backing would be judged at fault but that is not for you, the other driver or me to decide. Simply turn it in to your insurance company and they will handle it

    Q. Who is at fault if i hit a car who pulled out into my lane from behind a bus who had pulled up at a bus stop?
    i'm driving down a road with 2 lanes i was in the right hand lane and there's a bus in the left, 2 cars are behind the bus, the first one indicates and pulls out, the second one decides to follow her without indicating nor looking by the time i've braked i've just skidded until i hit her, and has its classed as a back end smashed would i be to blame, even though she never looked or indicated, surely i can't be held at fault, any response would be gratefully appreciated thanks in advance


    If you braked and skidded then you were driving too fast for the conditions: the conditions were: 1, a bus was stopped and two cars were stuck behind. 2, all other people are idiots Unfortunately due to condition 2 you will always have to anticipate that they (or even a bus passenger) will pull out into your path, so you must drive defensively .

    Q. Shouldn't a case be pro bono if a person has little on no income...and no fault injury hit and run child?
    16 year old and myself (mom). riding bikes. crossing with the green light in our favor. when a car decided to leave his spot in the intersection and make a left turn. when he did his back bumper knocked my son off his bike. he has one surgery. rehab recently has helped. the man turned himself in not returning to the scene and with myself as witness i don't understand why this man is walking around as the victum. my son has an atty. charging him 40 % now and recommending he accepts 30,000. this covers only dr. and atty. fees. prev. the atty stated he would ask for atty fees and pain and suffering. my son can no longer ride a bike or go up the shortest of stairs without pain. his atty states over and over if you don't blah blah consider accepting the 30,000 he will quit. ethics appall me here. 300,000. insurance is what the defendant carry and we have 1 mil. policy


    if you turn it down he gets nothing than go hire a real atty

    Q. I was backing out of a parking spot. whose fault was it?
    this morning, i parked my car at school, but decided i was a little crooked. i checked left and right behind me, there were no cars, and slowly started to back out. no one was near me. as i was ready to shift my car back into drive to go back into the space (and there was barely any way to get around me by the way), a car came racing up out of no where (going at least 20 mph in a school parking lot!) and had to swerve around me. it wasn't like i just didn't see her and backed into her. i was already in the middle of of the parking lot, had my foot on the brake, ready to go back into the space. i was already backed out of the space. later, when i saw her in school, she said that i almost hit her! i need help on this. was it my fault? i didn't think that it was, because i was already out of the space. she should have watched and stopped for me, because i was clearly in the middle of the lane in the parking lot. was it my fault? or hers?


    Herein is the problem. You paint a great story of how you weren't at fault. And how she was "racing". But to her, I'm sure it was completely opposite. That aside, she was the flow of traffic. You were entering traffic. Most times than not, that puts you at fault. You say you were clearly in the middle, but that doesn't mean you were to her. You weren't in her vehicle. Etc and so forth. The rules for parking lots aren't really that well defined, because there's a lot of vehicles moving around. Point is, no one got hit, it's over with, don't worry about it.

    Q. What to do when i've hit another person's car but it was his fault and he drove off?
    what happened: i was on a busy roundabout going about 20mph and i looked to my left and indicated to turn off into the next exit. as i was turning off though a guy in the car in the left lane of the exit, before the one i was about to turn into, suddenly decided it was a good idea to go speeding out in front of me. i pressed on my horn and literally had to emergency stop but as he came out so fast i still managed to ram right into his driver's side door. i also ended up stalling too. so as i was starting my car back up i pointed at him to turn off at the next exit so we could inspect the damage and exchange details but he just looked at me and drove off! it happened so fast and it was kind of dark plus i was in shock so i didn't think about checking to remember his license plate and in the end i was too busy getting out of the way of the other cars that were beeping their horns. i did pull over into a quiet road and checked my car and there were some minor scratches on the front of my car but nothing a little buffing and paint job won't fix. i reckon the other guy's car though must've taken the brunt of the collision because i heard a distinct crunching of metal sound (at the time i had assumed it was my car). however now i'm worried what to do in this situation because i was told as i'm the one who did the hitting i may the one at fault. plus because i'm a fairly new driver myself (only been driving for 6 months and still has a p-plate up just in case) i may be the one who is seen as inexperienced. but the guy didn't exchange details with me either so should i report it to the police still? i'm worried how my insurance rates will go up from this minor accident. please can anyone advise me on what to do?


    Always report any road accident to the police because failure to do so could lead to you being prosecuted. It was not your fault and I suspect that because he drove away from the scene he was either in an uninsured car or a stolen car or had been drinking. If the police ask why you didn't report it straight away explain that you didn't realise you had to until you read my advice.
