Q. When will insurance tell me after accident- benefits?
i was a passenger in a car crash, the other driver at fault both have insurance and i also have uhc my question is when will there ( the guy that hit me ) tell me what the benefits/coverage and what will be paid for as far as doctor bills etc? when will i get a settlement?

Q. Car accident and accident benefits?
i was hit from behind just over 2 years ago, my car was totalled and i had significant soft tissue damage (back, neck, arm and hand) and spent 5 months in physio therapy, also suffered post traumatic stress disorder and had to see a physcologist. i was considered not at fault and the driver that hit me was charged with careless driving. i was paid accident benefits from the insurance company to cover my lost wages however they are now saying they have overpaid me and i owe them money. can they do this? they received all the paperwork they required to determine the payouts so how could they have overpaid? do i ignore them or will they cancel my car insurance?


They can ask for the money back if they did overpay you. Ask them to prove it. If you owe them the money you owe them the money, but they have to be able to prove it. But from what you write, it sounds like either you're leaving something out or you don't understand why they're asking you for the money back. If you received duplicate benefits under 2 seperate coverages, then yes they can ask for the money back because 1st coverages prevent one from receiving multiple payments for the same "damage."

Q. Can you get unemployment benefits and ssi disability at the same time.will one affect the other?
i lost my job from a accident in my 18 wheeler.i applied for unemployment.i was then diagnosed with a brain tumor 4 days after aplying.i am now seeking ssi disability.i then found out i was approved for unemployment because no tickets were given.it was a no fault accident.i did not have insurance at my company.i cant pay hospital bills now without ssi disability.my question is can i get unemployment and ssi at the same time.i dont want to lose my ssi benifits by getting unemployment.is ssi and unemployment 2 different things.


SSI and unemployment are two different things. The monthly payment from SSI varies up to the maximum federal benefit rate, which may be supplemented by the State or decreased by countable income and resources. Unemployment is considered to be countable "unearned income" and can cause your SSI amount to reduce or cease, depending on the amount of unemployment you are receiving. Q. Minor auto accident my fault.. how/should i pay out of pocket without involving my insurance claim/points?
hit a parked car ... rather just pay for the damage since i have a high deductable. do i go thru the other party involved directly ot contact their insurance co, and agree to pay for damages. i do not think it is to my benefit in the long run to have this on my record as a premium will rise


UGH.. people have NO IDEA what they are getting themselves into when they pay out of pocket. Do you realize how much even one little scratch can cost?! Think about these factors: 1) What if you pay them and then they call you back and say the repairs ended up costing more? 2) You do realize you owe them a rental right? AT the lowest these repairs will be around 500... at the VERY LOWEST. Do you really think your rates are going to raise 500 dollars? Please Please know that 90% of these out of pocket claims go badly. Why do the job that professionals who are trained in the laws of car insurance are paid to do? I cant say enough about how much you will likely regret this. YOu have no idea how complicated it can be. Theres alot of very selfish people out there who (as nice as they seem) will end up trying to take and take.

Q. No fault acccident in ny, hit & run, what will i be compensated for?
i recently got into a hit and run accident. the other driver left the scene, there were no witnesses. a police report was taken and an ambulance checked me out. insurance company (geico) said it was a total loss. the car was financed and they(geico) will be paying the bank for the total cost of the car. besides the car being paid for, what else would i be compensated for? i already sent in my no fault benefits form. this is the first time i have been involved in something like this. thank you!!


as your insurance company stated, they will pay your total loss for your vehicle. your medical bills will also be covered through your insurance. however, you will be out of pocket for your collision deductible and any deductible you have for your medical coverage...these are things your adjuster can answer. also, depending on your state, you may be able to recover lost wages. as for your out of pocket...you won't be able to collect for this under umpd (uninsured mostorist) or uimpd (underinsured motorist) because in order for this to be used you must be able to prove that the individual who hit you does not have insurance or is underinsured. however, your incident was a hit and run...you cannot prove this as you don't know who hit you. sorry...but at least most everything else will be covered for you.

Q. Who is at fault in this massachusetts parking lot accident?
i parked in a spot, turn off the car, opened the door 1/3 of the way & sat in the car talking to the passenger. about a minute went by, & a woman took a left hand turn from the road in the the spot next to mine, crossing into my lined spot and colliding with my open door, and drivers side rocker panel. she immediately took responsibility for her actions. that is until she made the report to the insurance (of coarse. so much for giving her the benefit of the doubt). he adjustor says i am 50% at fault because a mass statute says any "doors are opened or opening resulting in a collision with another vehicle" is at fault. well i understand his point, thought the damage to the rocker panel (which does not open) proves she crossed into my lane and would have collided with my car whether the door was open or not (which falls in my favor under a different ma statute "collision with a lawfully or unlawfully parked vehicle"). i am about to argure my case to her adjustor, thoughts? comments?


It's not necessarily her misinformation that has her insurance company screwing with you. Go to the courthouse and get the form to file a small claims suit. You will have to go into Boston and get the name of the owner of the Insurance Company to name in the suit. Then skip the Adjustor, go right to the HOME OFFICE of her insurance company; calmly explain your situation. With paper work in hand, explain to the customer service rep that you speak to in person, that you plan to file suit in small claims court. They might cut you a check right there; like they did for me in a similar situation.

Q. I was recently involved in car accident with my children in the car. not my fault. we all suffered whip lash?
and bruising. my solicitor is now at the compensation negotiation stage, however because i care for my disabled son and claim certain benefits, will i be allowed to accept my compensation. someone told me that i would only be allowed to keep up to £3000, is this true and if so what happens to the rest. is this the same for the childrens compo? what about income support


i believe the sum is £6.000 after that a proportion of your benefit will be stopped over a certain sum (unsure) you could lose all benefits (even housing) they will not take any of your compensation but you will be expected to spend it before you can reclaim. check with your soliciter

you get paid for the total retail valu of your car and the insurance company will sell it at auction any procedes will go to the insurance company.If you have a lien on the car, the leinholder will get paid first and any thing left over you will get, If the value is less then you owe the you are liable for the difference. The only benifit is you get to shop for a new car and your old one will be paid off. If the car is drivable then the insurance company may let you keep the car and brand the title salvage, you will be able to still drive it and renew the plates but can only get liability insurance on the car. To remove the salvage brand you have to get the state police to inspect the car to certify that repairs were made.

Q. Should i get health coverage from my auto insurance if i am not at fault?
my wife and i were involved in an auto accident recently. we were hit from behind while waiting at a traffic light (red). they other diver aggreed that it was his fault. both of us have auto insurance from same company. his policy is covering damage to my car. my insurance company (which is same as his) says i get health coverage from my policy and not his policy. since it is from my policy, they say, i am subjected to deductibles and co-pay. my question is a) is it true that irrespective of whose fault it is, i get health benefits from my policy? b) if the other driver's policy is covering my medical expenses, will i still have to pay for co-pay and deductible? after all it is his fault and why should i bear additional cost? c) i have bodily injury liability in my policy. similarly other driver must be having the same. that means his policy should pay me.


You have here what is referred to as a third party claim. You have the right to be reimbursed for your pain and suffering, medical bills and legal costs. You should be awarded a lump sum. Do not go it alone, you must get an attorney to look after your interests and get the best possible outcome. When you commence such an action the other parties insurance pays all costs.
