    Parking lot accidents are no fault and you don`t lose points. Your insurance is usually not affected because charges are not laid.

    Q. A car was one the median and cut in front of me as i was driving and i rear ended him, whose fault?
    i was on a two lane road and driving on the left hand side. the driver was never driving in front of me on the road. there was a car parrallel to me on the right lane. i was driving 5mph below the limit when a car on a median shot in front of me without looking. i rear ended him and he says it is my fault. whose to blame?


    This probably will depend on the points of impact of each car. If the car made it into the lane and you struck it directly from behind, you'll probably be at fault. If you struck closer to the side of the car, that proves the car was in the process of moving over (unsafely) when the impact occurred. Did police come to the scene? Are they writing a report? Any witnesses? Good luck

    i was stopped at a stop sign and proceeded to inch out to see oncoming traffic(in arizona) at a stop sign to make a right hand turn and the car behind me ear ended me? i was thinking about going however i saw a car coming into the lane i was going to turn into so i didn't go and was rear ended the driver that hit me said he thought i was going to go. i would assume he's at fault am i correct? i was rear ended not ear ended

    Q. Am i responsible for my insurance deductible if i am rear-ended in a no-fault state?
    i was a passenger in an accident where the car i was in was rear-ended and suffered medical injuries. i was told that since i live in a no-fault medical state that i would need to use my own car insurance which has a $100 deductible. can i recoup this loss from the other driver's insurance or do i need to go directly to that individual via small claims court?

    Q. My car rear ended hit car in front . rear car admitted fault now 1st car said i hit her first i charged sec 3?
    i was involved in 3 vehicle accident my car was rear ended and shunted into vehicle in front which was stopped in traffic queue. i was stopped or almost stopped at time . driver at reat said sorry her foot slipped. i was taken to hospital - whiplash etc. police said first driver said i hit her first. then hit her again when shunted forward. also cos front of car was badly damaged must be my fault. i disagree but was charged with sec 3 rta. my car was a write off. keep going over accident in my mind but still know i was stopped at time. whats my position . do i get points on license can i claim rear driver for injuries to hip neck etc. someone please help.


    If you were stopped, and car behind pushed you into car in front, the car behind is 100% at fault for hitting you. Damage and injuries attributed to that collision you can claim for. You are 100% at fault for hitting car in front. You didn't leave enough space. If you can't see the ground where the wheels meet the ground when you are stopped at a red light, stop sign, etc, you are too close. Sorry. It matters not a whit whether you hit the car in front before the guy behind hit you, or he hit you first, the collision with the car in front is 100% you fault, the difference is the wording of the report and the charge laid. Either way, you get a ticket.

    Q. Rear ended, at fault party has no insurance. what to do?
    i stopped at a yield sign in order to yield to another vehicle. i was then hit from behind. the man claimed he could not find his insurance information but did write down all of his correct personal information, liscense and plate numbers. he contacted me and said his insurance is no longer valid but that he is willing to pay for damages. do i still need to report damage to my insurance company? should i get a lawyer? there was no police report filed. please any advice is appreciated.


    In this case you should absolutely report it to your insurance company because now they will get to do their job! They will contact the person who hit you, make sure that the damage is covered, get the law involved if needed...everything! This is what you pay for so tell your insurance company everything and let them handle it.

    i live in australia, got rear ended, made me hit the car in front as well compulsory third party, comes from the government when paying registration


    from personal experience the person that hit you will be liable for both your car anh his as well as the one he has forced you into. you wont get a "payout" as such but his insurance should cover the repair of your vehicle (if he had full comp) if his insurance is like yours, you are all liable for your own vehicles.

    Q. Car accident.. other person at fault (rear ended)?
    my wife got rear ended and the insurance company called and said there driver was at fault. we don't want to sue no major injuries. they said they will fix our car. do they normally offer you money for you aggravation? she was hit by someone doing 55mph. still her and our two kids are still very sore... it happened on july 24th 2009 there insurance only called us once since then. still did not fix car yet....


    You have to get your car to the body shop for an estimate. Their insurance company needs to know what to cover. Did you talk to your insurance company? When we got in an accident (other person was at fault), we were towed to the body shop, they did an estimate and sent it away to my insurance company, who covered it and dealt with the other person's insurance company. All in all - we had our car back after a week. Also, if your wife and kids are still sore - be sure to get them checked out. Whiplash can be a real bugger. You have to let the other driver's insurance company know that there were no serious injuries, but you are getting checked out for whiplash/whatever else is wrong. It shouldn't take a month. Be sure to talk to your insurance company and theirs!

    my friend rear ended another person in a parking lot because the girl she hit sped up and then slammed on her brakes at the last second. it was not bad cause they were going at a slow speed so the police did not get involved. my friend got a few scratches on her car and the other girl had no damage. was it my friends fault or the girls fault?


    Your friends fault for not leaving enough room to stop. Doesn't matter if the other driver slammed on the brakes as it could have been someone jumping in front of the front car she was trying to avoid.

    Q. My brother in law was isued a at fault ticket when he rear ended a car in the snow, can it overturned?
    my brother in law was driving on the high-way during a sudden snow storm when he slid into the car in front of him. he was issued an "at fault ticket" for driving unsafely for the conditions of the road. now his insurance company has notified him that he either drops himself from his joint policy with his wife or that he pay a 28% premium rate increase. he is going to court to dispute the ticket, however i told him that i thought that he could not have the at fault ticket overturned and that the best he could get would be to have the ticket $ amount lowered or maybe the points lowered. am i wrong? he asked me to contact his insurance company for him (he does not speak english very well) and tell them that he is disputing the ticket and he does not agree with the increase. i am trying to find information for him outlining the maryland "at fault" guidelines so that he understands better what he is up against. can anyone provide me with information that might help either way?


    The insurance company is right. Your brother can fight the ticket and win, but the insurance company already read the police report and have the facts in front of them. They will increase his premium regardless of the court ruling on the ticket. The premise is that they run an extra risk by having him as a driver and they expect more money to insure him.
