i was hit from behind just over 2 years ago, my car was totalled and i had significant soft tissue damage (back, neck, arm and hand) and spent 5 months in physio therapy, also suffered post traumatic stress disorder and had to see a physcologist. i was considered not at fault and the driver that hit me was charged with careless driving. i was paid accident benefits from the insurance company to cover my lost wages however they are now saying they have overpaid me and i owe them money. can they do this? they received all the paperwork they required to determine the payouts so how could they have overpaid? do i ignore them or will they cancel my car insurance?

They can ask for the money back if they did overpay you. Ask them to prove it. If you owe them the money you owe them the money, but they have to be able to prove it. But from what you write, it sounds like either you're leaving something out or you don't understand why they're asking you for the money back. If you received duplicate benefits under 2 seperate coverages, then yes they can ask for the money back because 1st coverages prevent one from receiving multiple payments for the same "damage."

If you are on any type of public assistance, they need to know anytime your finances change. Receiving 4k is quite a chunk of money and may either lower your benefits or disqualify you. Look at it as double dipping..you have money now to get on your feet according to the government, but yet, you still want a handout. How is that fair to the taxpayer?

i'm a operation iraqi freedom ii veteran and served active for over 1year on tour, involved in a civilian car accident. i haven't been separated yet but will have to go in front of a separation board, i'm assuming it will be a honorable discharge because if it weren't because of this accident i would complete my last year on contract. i'm a veteran so i don't have to have 24 consecutive months.

That depends. If you received an honorable, general, or under honorable conditions discharge and you had 24 continuous months of active service, you're eligible. If you have less than 24 continuous months, then check out the VA's website below to see if you still qualify.

1.) Depends of your friend was at fault or not. 2.) Get a lawyer AS SOON AS POSSIBLE. If your friend was not at fault, your lawyer will be going after the person who's fault it is (their insurance company). If it was your friends fault, your lawyer will be going after their insurance company. If your friend did not have auto insurance then your lawyer will be going after them personally. Get it done or go bankrupt.

You can speak to an attorney.... but that is all you will do is speak to him. No attorney will take a case like this as there is no money in it for you or them.

You may not get something as generous as that, but if you promote the event, they may let you keep something like 10% of the profit.
