    Parking lot accidents are no fault and you don`t lose points. Your insurance is usually not affected because charges are not laid.

    Q. If a car backs out from a driveway and hits a moving vehicle, whose fault is it?
    i just got in an accident where a car backed out from their driveway and hit my passenger side door while i was driving down the street. whose fault is it? i'm just afraid that they'll somehow twist the situation to make it look like it's my fault. thanks!


    You're only suppose to back out, when clear. The people on the road aren't suppose to stop for you.

    Q. I was parking on my son in laws driveway and he backed his vehicle into mine. who is liable for the damage?
    we both have insurance and both live in wi. the accident happened on his property. i hate to make my son in law pay for my damage, but feel it was his fault as he failed to look in his rear mirror, and i didn't even know he was in his vehicle til i saw his back up lights. honk! bang!

    Q. A vehicle backed up into me at a stop light damaging my bumper . how will allstate handle this?
    the man was speeding and could not stop fast enough at the stop light. he ended up in the middle of the intersection and had to back up. he slammed into me and tried to flee the scene. i followed him, he finally pulled over, i called 911, a police officer came and wrote up an incident report showing the driver at fault. i have a $1000.00 collision deductible with allstate. the driver also has allstate insurance. will i have to pay to get my bumper fixed?


    No. If the police report shows him to be at fault, then Allstate will cover for the damages completely. You must only pay your deductible when it is deemed that you are at fault in a collision.

    Q. Back and neck injury in company vehicle, not my fault, i was hit by another car?
    an 18 wheeler truck hit a car, which threw the car into the back of the company vehicle i was in. i am having bad neck pains and a little back pain. i am wondering the steps i should take all around to get this resolved? my company is currently putting me through therapy and i am seeing a doctor, but what do i do if i can't work right now? i have never had this happen to me. also, if my company doesnt pay me, how can i make the money up?


    You should be filing a claim against the at fault driver. If you are considering this a work place accident, and going through your companies Workers Comp policy you making a hugh mistake. If you are unable to work file a disability claim with your state to keep some income coming in. Depending on you states rules you may or may not have to reimburse them for disability payments from any settlement you may get. But your major claim shouldd be against the at fault driver.

    Q. Who is at fault if i walk behind a vehicle that is baking out of a parking space and it hits me?
    when i was in elementary school, cops would give us traffic safety lessons once yearly. one thing i remember is that it is unsafe to walk or ride your bike behind a vehicle that is backing up. now it seems almost everyone does it and they get mad at the driver if they don't see them! and they are teaching their children this behavior. won't it be a great lesson for the driver if you have to bury your child? is there a law regarding this situation? do pedestrians always have the right of way?


    There is a myth embraced by the stupider among us that goes something like this: "Pedestrians always have the right of way". If you check your local DMV codes, you will find that this myth is certainly not true. If you drive through the parking lot of your local Wal Mart, you will find an assortment of lowlife peds who firmly believe that they have the right of way, no matter what. To protect themselves from the error of their judgment, they often send their three-year-olds out into traffic first to make sure that the car that is coming will stop for them. Here's just one of several excerpts from the California Vehicle Code that outlines for the stupider among us exactly what it means to be a smart pedestrian: 21954. (a) Every pedestrian upon a roadway at any point other than within a marked crosswalk or within an unmarked crosswalk at an intersection shall yield the right-of-way to all vehicles upon the roadway so near as to constitute an immediate hazard. (b) The provisions of this section shall not relieve the driver of a vehicle from the duty to exercise due care for the safety of any pedestrian upon a roadway. What this means for the above-mentioned "stupider among us" is that if you are a pedestrian, and you expect to be granted the right-of-way to a motor vehicle, your azz had better be in either a marked or understood crosswalk or you are what is called a "target". It also says that drivers are required to think for the stupider among us so we don't inflict injury upon them because of their stupidity. There are several more references to pedestrian responsibility and how it relates to motor vehicle safety that can be found at your local Department of Motor Vehicles, but I swear to God if you need tutoring on such a thing, well perhaps you need to go back to first grade. That's where I learned this stuff. If you really want to challenge cars with your body or your children, copy and paste the following epitaph and email it to your local headstone maker so he won't have to guess: "Here lies (your name here), who insisted he had the right of way."

    If it's clean and it matches the color, you'll have a hard time getting a new one.

    i've read that there's possibly contributory negligence on my part, but also that the moving vehicle has the burden of care since she ought to have been in control of her car, i'm confused. if she is at fault, will my insurance rates go up?


    You were parked. It does not matter that you were double parked. She hit a stationary object. She should be 100% at fault. Call her insurance company and file a claim. CA follows the Pure comparative negligence rule meaning even if you were 80% ar fault for an accident you could still recover 20% of you damages.

    Q. Is a driver liable to pay any money towards company vehicle even if accident is their fault?
    our company driver reversed into a telegraph pole that was in their blind spot and damaged the back door and bumper of the van. the company boss has said that the driver has to pay the excess on the insurance and also the charges for a hire vehicle while the van is being repaired. are they allowed to impose this on the driver and is the driver liable at all to make a payment towards the van? the company has public liability insurance so im guessing he does not but would like to know the legalities if anyone knows????


    Companies have to have their vehicles insured. If this is a COMPANY vehicle that is used only for business purposes (meaning the driver doesn't use it just whenever he watns) then no. They cannot hold that on him. If it is HIS car that he is using for business purposes, the driver would have to report that with his insurance. I would say that would be the best way to go. The driver should call his insurance to find out who is liable for repairing the damages. I had a friend who was in an accident with a work truck. And he was not liable for a single thing. His company paid everything. *monkey*

    we were in a parking lot and someone else was driving my car (i was in the vehicle) and someone backed into us. will anything happen? it was not our fault, whatsoever. i mean, will my insurance not cover it?


    Insurance goes with cars, not with drivers, but your insurance isn't being affected here unless the person who hit you was uninsured and won't pay for the damages. Who was driving doesn't matter, if the other vehicle has insurance, make a claim. If they don't, you can claim with your own company if you have uninsured motorist coverage.
