Is there an industry standard for a car accident pain and suffering claim? i was in an accident when i was 34 weeks pregnant and it put me into pre-term labor (very scary). i was put on medication to control the contractions and have been ever since. the other driver's insurance company accepted fault. my medical bills were covered by my insurance but totaled $2239.00. we are waiting until after the baby is born to settle "just in case."

Yikes.... i knew someone woudl say the "3 times medical" thing... please please know.. this is completely absolutely ridiculously untrue. I dont know who even came up with that!
You wouldnt believe how much someone who wants money can rack up in chiro bills they dont need... ive seen people with a little scratch on their bumper rack up 30k in chiro bills! Adjuster will never give 3 times that in medical! theyd be lucky if they even got their bills covered!
"Pain and suffering" is based on permenancy and extent of your injury and future medical expenses...
In your case.. if your baby is born and is fine... i would say about 5k or so... this would be for any out of pocket or lost work you had... and a little extra for the "pain and suffering"- just keep in mind.. its not the lottery.
I know the experience sucked.. but your not permenantly injured.
Just be reasonable and dont expect to win the lottery and youll be fine! and think twice before you listen to alot of people on here!

I don't think there is a catch. I do think if you do not get to the doctor within a certain period of time it could cause a loophole where you wont get any compensation. If you were injured, there should be no problem proving this, I would go to my own doctor though, If they would allow that.

i have look into hiring a lawyer since day one! plus talked all insurance compaies. i have 2 years to trurn all expences. i have already got money for my car. my heaklth insurance has been covering all my expenses, but they want thier money back! from someone!!
howevr the all lawyers i have talked to want over 30% of what they get including med and pain payment.
so why would i want to give a lawyer 30% for doing nothing. won't the lawyer suck up 30% of the total case, leaving me to pay for doctors, wiht my pain and suffering!!

what should i do and how to do it?
Many questions/issues, but I have many answers!
1. Fair amount for "pain and suffering"? I can't really say, since you didn't tell us what injuries you sustained. The settlement for that will be based off of the specific injuries, not bills, not time off from work, etc. If you sprain your ankle and miss 3 weeks and spend $8000, that doesn't change the fact that you have a sprained ankle. You obviously are hurt worse than that, but the answer to this specific question relies too heavily on information we don't know.
2. There is no maximum you can claim. The insurer will NOT settle for more than their policy covers the other driver. Also, the insurer will not tell you what their limit is unless your injury obviously exceeds it. They will say something like "Our limits provide enough money to settle your claim" and leave it at that. If their policy limits are not sufficient, you can always make a claim for Underinsured Motorist on your own policy. Your rates will not go up. Also, be aware that in California, if you were determined to have any fault in the accident, even as little as 1%, your award will be reduced by that amount (you were 1% at fault, you collect 99% of your damages. You were 40% at fault, you get 60%, etc.)
3. The "pain and suffering" settlement will be part of your medical bills. You have a set amount of time to SETTLE your claim, 2 or 3 years in CA. If you have not settled by then, the only way to extend the window is to sue the other driver. When you settle your medical claim, they will have you sign a release that prevents you from suing the other driver or coming back to them for more money. Be sure to get it right the first time! They should cover 100% of your medical costs, 100% of your lost wages, and add in the "pain and suffering".
4. If you hire an attorney, be prepared to have them take 30-40% of your settlement. It's a big chunk, so make sure that your medical bills and lost wages are covered after they take their cut.
5. If you decide to get representation, hire an attorney that is experienced in personal injury. Good lawyers are busy lawyers. Busy lawyers don't usually have time to send you letters soliciting your business or spend a few days in a studio shooting a TV commercial. Good lawyers tend to advertise very little, because they don't need to. Their satisfied clients advertise for them. If you sign with an attorney, they will find a good MD for you to visit.

You biggest problem is you haven't obtained treatment for your injuries. The insurance company is going to think that if you were really hurt or hurt bad enough to cause problems in your life, you would have obtained treatment earlier. If you seek out treatment now, they'll likely deny it for the same reason. Soft tissue injuries tend to heal on their own within 6-8 weeks.
I could probably give you a estimate of an injury claim based on 2 months pain and suffering but that would be assuming you were doing something, anything, to reduce it (such as physical therapy like you mentioned).
I'm sorry but you screwed yourself over. Even if you took the other driver to court, your injury claim will likely be minimal. You'll be lucky to receive $1,000.00 plus payment for visit to the doctor and you're more likely to receive about $500.00.
Had you begun treatment for your injuries right away you could have probably received $1,500.00 for your pain and suffering plus the cost of your medical bills and you wouldn't be in any pain by now.

A whiplash injury is considered minor. Your PTS claim will be challenged for sure. Do you anticipate further treatment? If not, how traumatic could this accident have been?
If you are tort eligible, the adjuster will evaluate your claim based on the nature and extent of your injury, disability, and treatment.
If you live in a state that requires PIP, your medical expenses need to be paid through your own policy. Otherwise, these expenses will be included in the settlement offer.
Case values vary widely from state to state even venue to venue within some states. Expect a settlement of no more than $2k-$2.5k plus meds and wages(assuming you do not have PIP). This settlement could be higher or lower depending on where you live. This is just my opinion, based on claims handling experience.

Oh, for crying out loud, stop wondering about money and seek some treatment for your back and neck pain. You will not get nearly the money you think you will and quite frankly, you should not. Maybe a few hundred dollars, the rest is for medical bills, and lost wages if any.

Ohio may or may not have a cap on what you can receive for pain and suffering. Some states do; some don't. But whatever you do talk to a lawyer! This is vital ... unless you're willing to settle for far less than what you should get ... cap or no cap.
An injury lawyer won't charge you anything for information and will probably represent you without any money up front. If you learned anything from your past experience you will talk to an injury lawyer. Most will charge you only if you win. Flip open the Yellow Pages ... they've got scads of ads. Sure, they'll take a percentage of your award ... that's how they make their money. But you'll be much better off!

It will depend on the circumstances of the accident, If your friend was drink driving or driving recklessly and it was recorded the he was driving recklessly it is unlikely that the insurance company will cover it, but regardless, check with the insurance company NOW. If you wait and then they say "You were meant to file the report straight after the accident" you'll be in trouble, but if they say come back when you get all the bills, at least you know.
