Most states' statute of limitations on lawsuits for these sorts of things is one or two years. Since your friend is being sued two years later, I'd bet that your state's statute of limitations is two years.

If it is one year in your state, you have to file the lawsuit by then, it doesn't have to be "closed" by then. You should file as soon as possible.
You have a chance if you can prove that it was their pipe, that they didn't secure it properly and that you were damaged by the pipe.
You cannot sue for more than your actual damages. Since no one was injured, you are suing only for the damages to the car.
You may be able to sue in small claims for the $4000, depending on the limit in your state. If you can't sue for the full $4,000 in small claims, you are probably better off to take the $3200, as filing in a higher court is more complicated and you may need a lawyer to help figure it out.

I can't see a reason for you to sue at this time. If the other party's insurance company doesn't deal fairly with you, then you might want to sue, but definitely not yet.
Unfortunately having to deal with life's troubles isn't necessarily justification for a law suit. As the injured (not-at-fault) party, you are entitled to repair of, or replacement of (Blue-Book value), your vehicle and the cost of a rental car while you are out the use of your vehicle (if it is being repaired), or until the company makes you a reasonable offer to settle the property damage portion. You can also demand damages for his loss of work, medical and pain and suffering (which he is also entitled to - you are not). If the company is paying for the vehicle replacement, that's the bulk of your damages from what you've said. Demand that the insurance company also pay you for the rental car expense, his lost wages, & double his medical costs incurred (for actual medical & P&S) in order to settle. Most likely they will settle with you for that & they will be glad no attorney is involved. Be thankful that your husband wasn't hurt & give him a big hug & tell him so.

the not-at-fault driver has an attorney, by the way.
so now, here's the question. at this point, would filing suit slow the entire process down? the insurance company has stated in writing that they will pay off the vehicle. but how long will this take? seems to be a really slow adjuster or something.
with the evidence, there's no way this will go to court. witnesses, drunk driver, injured victim, etc. no way. but will filing litigation speed things up or slow things down?
If the not-at-fault driver has an attorney, the decision to file suit would be between attorney and client. In my opinion, a suit would slow things down. Quicker to call the adjuster's supervisor and nicely ask for an explanation of the delay.

It depends on whether or not the defendent chooses to contest it. A court date is set. Then you have a deposition. Then it's a lot of stuff that your lawyer handles with offers and counteroffers. It's cheaper for everyone involved if it's settled before it goes to trial, but if it does, it could be a very long time before it's settled.
Lawsuits also raise liability insurance premiums for everyone. That's what insurance is. Everyone pays into an insurance company, which invests the money, and that money is used to pay claims. The more money going out, the more the company charges for premiums.
Unless the company is giving you a hard time and not paying like they should (it has been known to happen), just work out the claim between your insurance company and theirs.
