i live in ca, where i got into a car accident that wasn't my fault. my friend was in da car and she is claiming back aches (which was a pre exisiting illness of hers) the insurance guy verified i had valid insurance b4 he paid out the injury claim. i am no longer claiming injuries, but my friend is. would she have to have valid insurance for him to pay her for bodily injuries, since i am no longer pursuing my claim?

No. If she was injured, she can file a claim against the at fault party. Just because you were not injured does not mean she was not. However, while she may think she is pulling a fast one, the claims adjuster will find out her back injury was pre-existing. Her claim will be evaluated and a reduction for prior the prior condition will be considered.

Q. How long can you wait to notify a insurance company about a potential claim?
how long can you wait to notify a insurance company about a potential claim? you know how an insurance tell there clients that they have to report a claim(personal injury/premise liablity) or something. most insurance policies have a requirement that your notify the insurance company of any potential claim within a very short period of time after the incident occurs. i live in ny. how long can you wait to tell them? how much would that short period of time be? landlord have been recieving letters frommy lawyer and he havent sent them over to his insurance company. this been going on since may 1st of this year. can the insurance deny him coverage?

If you want any help from insurance, you call them "NOW" Any insurable claim has to be reported so they can be part of initial investigation If you leave them out of the loop, they will leave you out of the loop. What does that mean?? Instead of them helping you, you have to sue them, and that means you have to prove in court, that they have to cover you. It is better and cheaper to have them as partners instead of adversaries

Q. How long to settle an injury claim?
i am wondering how long it usually takes for insurance companies to settle auto bodily injury claims. i rear-ended a driver at a stoplight at about 5mph back in july. he complained of no injuries at the time, officer noted no injuries. anyways, he later made a claim against my policy, and my adjuster said it is still unresolved (been about 3 months now). is it normal for it to take this much time, or am i about to be taken to court? my insurance apparently covers to $100,000.

These things sometimes take years. Sounds as if you have plenty of coverage. Set back, relax and let your insurance handle everything. If you are sued your insurance will represent you. 95% of the time these things are settled out of court and you won't even know about a settlement til you get a letter in the mail. You have insurance, let them do their job.

Q. The other driver's insurance company wants me to sign a release on my injury claim. how long can i delay this?


"Go the the department of insurance for your state and they can advise you..."



they should tell you how long the offer stands and the release should state something to the same effect. if anything, just ask them how long you have to think about it and ask them about the things you are concerned about that makes you want to delay it. if you don't feel comfortable, or if you feel they are trying to rip you off, go the the department of insurance for your state and they can advise you. a lot of people will tell you jump into getting an attorney, but try to avoid this. in my view, they just take the money for something that's all yours to begin with. you should only get an attorney when you have no other option. they usually take anywhere to between 20-50% of your settlement. do you really believe they will do enough work to earn that much? if so...hire one...if not...explore all your avenues first.

Q. Do different types of injuries affect the length of time needed to sort out a personal injury claim?
(i'm in the uk) last christmas my brother's car was hit by a woman who pulled out of a slip road onto a main road without looking. she hit him head on and his car was totalled. my mother who was in the passenger seat was taken to hospital by ambulance, and found to have a broken sternum. the woman in the other car admitted responsibility at the scene and police suspected she may have been drinking. the insurance claim for her personal injury is still going on! my mum has been sent to see two separate doctors to assess her case. in february, my bf had a smiliar accident - silly bint pulled out etc, but he did not suffer severe injury, just back pain which kept him off work for a few days. woman did not immediately admit responsiblity and had not been drinking. he's already been awarded £1,500! what i don't get is why such a cut and dried case like my mum's is taking so long whilst a case like my bfs (which i thought wouldn't come to anything) has been sorted already


ask your lawyer if he can speed it up

Q. A guy ran over me. how can i avoid calling his insurance while i see if my injuries heal on their own?
here is the problem. i don't want his premiums raised. i guess my whole question would be. how long can i wait for the injuries to heal before his insurance claim officer can say "sorry, you waited too long to contact us and you'll just have to pay for your own medical care".


Whatever the statute of limitations is, in your state. It could be anywhere from 18 months to 7 years. HOWEVER. If you don't get treated right away for the injury - if you don't confirm it with a doctor or hospital - you're going to have a darned hard time proving that your doctor visit, four months after the hospital, was because you had injuries from an accident way back when. Also, they don't pay for your medical care up front! They will reimburse you later. Maybe. If there's coverage, depending on what state you are in, and several other things.

my insurance claim got settled with progressive over a week and a half ago. i was just wondering how long will it take to get my check.


"How long will that be..."



As soon as everything has been finalized, and the check cut, signed, and mailed or handed to you. How long will that be? No idea. Ask Progressive. It will definately be longer than a week and a half apparently.

Q. How long does state farm take to settle a claim?
i was in an auto accident about 5 months ago and i was at fault. i have state farm and they have already settled the property damage, but the bodily injury claim for the person i hit still remains. how long does this process usually take to end? the person did not get an attorney or anything, my insurance is taking care of it, so is it normal for bodily injury claims to take this long with out attornies getting involved?


If the person is still treating for their injuries, then yes, it could take 5 months, or longer. If the person is done with all their treatment then state farm has to order all the medical bills and records relating to the treatment the other person received. they will evaluate the file and then offer the other person a settlement amount. Have no fear though, just bc a person treats for an excessive amount of time, does not mean they are going to be compensated for it!

It shouldn't be too long. But each carrier is different. You want a reputable company and then you can expect a fast claims turnaround. If you are dealing with a company like Geico, don't hold your breath. Some states set guidelines on how long the process can take and when the carrier has to initially contact you after you submit a claim . Your best bet is to contact the adjuster, if you have already been assigned one and ask them the average amount of time.

Q. Car insurance claim agent refuses to pay with bodily injuries on the record?
i got in a car accident at the beginning of the month (i was rear-ended and the fault has already been accepted as the other party's). the passenger in my vehicle immediately had swelling on the neck (a huge, red knot that was really hot) and felt very sore, so naturally, we both went to see a doctor, as i was incredibly sore and very dizzy. the doctor recommended that we take two days off (separate facilities mind you), and gave us both medication. i alerted both my own insurance and the other party's insurance that we had visited a doctor because of our uncomfortable state. i told them i was waiting to see if my health insurance would cover my own visit, as in most car accident's here in california, they will not and send it to the car insurance instead of the medical. about a week later, a letter was sent out to both myself and the passenger from the other party's insurance company stating they would pay x amount for the car's repair and x amount for my own personal losses. i was fine with this and called to accept. when i did so, not only did the agent claim that i have nothing wrong with me because the accident wasn't really severe, but that i was lucky to get anything for the car repair itself (the check had already been mailed). the agent claimed that they had never sent out the letter stating the x amount they were giving me for my personal losses and that i was lying to cheat them out of money. she offered me an incredibly low amount that was highly unreasonable and nowhere near the amount stated on the letter she had personally signed and i stated i would feel better faxing her a copy of the letter she had sent me already because it was the fairer of the two. the agent went on to state that i should not have seen a doctor because there was no need and that the fact i listened to the doctor and took just one day off work was my own fault for, and i'm paraphrasing here, being a "wimp" because i was sore. she ended the conversation by stating she was suspending my claim because i was not cooperating with her and that if i decided to come to my senses she would consider about a 1/4 of the original x amount in the letter. what can i legally do? i have tried contacting auto lawyers but of course this isn't an entirely serious claim and they stated it wouldn't be monetarily worth it. there has to be some law regarding the fact she sent me a letter already with an estimate and is refusing to acknowledge that. is there anything i can do? this is not really about the money so much as just not being swindled by some shady auto insurance company. thank you. any advice is appreciated. i know its a long shot, but there's got to be something. i'm planning on faxing the copy of the signed letter stating the amount she sent me as proof that she did, in fact, send me that letter with the x amount printed very clearly stating the insurance was going to compensate me. this question details communication with the other party's insurance. however, when i called my insurance company, they stated they cannot legally talk to the other insurance company. i have all state. they stated it had something to do with being california. is this true? they told me it was up to me to deal with this.

Screw em all, Hire a lawyer!!!!!! It is in fact the insurance reps job to scare &; intimidate you into accepting as little as possible. as for you cooperating, you dont have to, infact you SHOULDNT! you would be cooperating with a someone whose interest is NOT being fair. The best thing you can do is call a lawyer NOW, and dont agree to anything until you do. EDIT: you can take them to small claims court without a lawyer, but there is a $5000 max. if your med bills are more than that, small claims wont cover it.
