Q. Is an accident in a parking lot no fault?

"Parking lot accidents are no fault and you don`t lose points..."

Parking lot accidents are no fault and you don`t lose points. Your insurance is usually not affected because charges are not laid.

This answer closely relates to:
  • Parking lot accidents
    • Who is at fault in parking lot accidents?
    • Is a parking lot a no fault zone for car accidents?
    • Can you go after someone s insurance in no fault zone?

Q. Will aaa of southern ca raise my insurance rates for a no-fault accident?
i have aaa of southern california auto insurance. while my car was parked in a parking lot, a vehicle hit and damaged the front end of my car and then left (i was not present at the time of the accident). will it raise my insurance rates to report this accident and then have the damages repaired?

In general, there is usually no action taken for non-fault losses. Reporting a claim does not affect your rates.

Q. Do the insurance companies raise their rates if an accident is reported but there are no monetary claims?
i was involved in a minor fender bender in a parking lot. a guy backed his car and hit mine. there were no damages but it upsets me that the guy just took off without saying anything. i got his plate #, the make and model of his car. if i report the incident to his insurance company will they raise his premium even though i have no financial claim?

"Accidents..."

I think then best move would to let your insurance company know about this so you are protected and they have your side of the story. Jeff had some valid points about rates and "rateable" accidents. This does differ by company and state regulation. I would like to point out that no one here knows your driving history and State Regulations and no one here is using the title “underwriter,” so no one can give you a 100% answer on your rates. I agree that your rates should not(not “will not”) increase. Back more to your question… If you report this to his company, his company will most likely call him and address this with him directly before closing their file. If he denies this they will take his side and your cause is lost. The adjuster will not call you back because they have no reason to since there was no damage and they will most likely just close their file. Just to cover everything… The only negative I could see is that if you antagonize him by calling his insurance company, he may say that you hit him and if his damage goes over his deductible his company may pursue you(your insurance company for reimbursement). He can’t prove that you did it, but it will tie up your company’s resources. You can file a police report but it was private property and the other driver could do the same thing. Some companies claims departments back up their policy holder so much that they will pursue their policy holders deductible + the 15 dollars they paid over the deductible knowing they have little potential(spending hundreds) to get money back. If it is not your fault, again your rates “should not “ go up, but it just ties up resources. I would recommend telling your insurance company so that you are protected. Even if you tell his insurance company, all he has to do is lie and no one will investigate further since there was no damage. His claims department would record the accident as your fault (his companies opinion does not mean anything to you though) and close their file. When his policy comes up for renewal, they will see an accident but most likely not at fault.

Q. How much insurance company will raise my rate after a car accident?
my car bumped into a car at a parking lot and caused minor rear bump crack. and i called my insurance company to report a claim. right now my rate insurance is $420/year. i would like to to know how much my insurance company will raise my rate when i renew it next year.

There no easy answer. It depends on your carrier and your state. Some carriers offer accident forgiveness if your insured with them for a number of years and never made a claim, then they give you an accident for free. There are also $ limits. If the amount they pay for repairs to your car and the other car exceeds a certain predetermined $ amount then the policy is surcharged. If its below that amount, you aren't given a surcharge but may lose your accident free discount. When you do recieve a surcharge, it is only applied to certain coverages and not all the coverages.

Q. Parking lot accident? i hit them but they did something illegal?
so, im in the wendys parking lot today getting food, and well...... i hit someone. two friends in the car with me, only one saw it happen, but there is more to it than that, heres what happened. 1. start my engine, see a woman walking out the wendys door 2. my passenger in my back seat tells me there is nothing coming 3. i check that for myself, nothing there (i looked in all my mirrors) and put it in reverse, had to give it a little gas to get out of a rutt 4. i begin looking out my left window, nothing coming, boom!!!! 5. i stop, look in my right mirror, and there is a car, just stopping after i hit it 6. the woman that walked out of the wendys is standing 3 feet away from the car i hit, yelling, cussing, and holding her back saying shes hurting. i pull my car back up into the parking spot, other car goes and parks. 7. well, turns out, the car was picking her up in front of the wendy's and was doing something illegal, offloading/picking up passengers in a driveway. so, the way it goes, i was backing up, and the car raced past me and i hit it, the woman says she was hurt but was never even hit, or even in the car, just standing there waiting for the car to come pick her up. the person driving the car (the womans boyfriend) should have seen my back up lights on, but raced by me and i hit him. there was lots of people in wendys, but other than one of my friends in the car with me (the other was texting on his phone), nobody saw how it went down, so i'm kind of outta luck on witnesses. not really any damage, no damage to mine (steel bumper), and nothing more than a little pressure dent in the left rear door of their car, only less than 1 mph backing out so really, there is not much of a lawsuit, except i have the woman that went back into wendys after the accident, and was walking around holding her back in front of all them people saying she got hurt. great.......................... thats gonna get her a good 150,000 dollars out of my insurance and raise my rates to $500 a month. when i called the cops, they could not come because it happened on private property (wendys). i asked the woman if she needed to go to the hospital, and she said very quickly "no!" so i just know that shes faking it. no cuts or blood though i think i am going to get screwed on this anyway, i got a dent in a door, a crying woman, and i hit them, and it was really their fault. but really one good thing exists, the woman did not go to the hospital, so that means she can't prove she was hurt without a medical report whew!!!!!!!!!! info to help if needed 1. accident happened in the state of missouri, however both cars are registered in the state of kansas 2. happened on private property 3. only 1 witness in my favor 4. i was backing out slowly and probably less than 1 mph please let me know any tips or advice, it would really be helpful because i just feel in my heart i will get screwed in the end thanks to any help also, if may help the case, there is no police report made, because the police would not come. and i checked the missouri highway patrol website and there is no report of an accident either. i checked with my insurance company, and they told me without a police report, they will not pay off as there would be no legal proof of an accident. so whats that mean? in response to "elayne" about the scratch marks, there was only one, it was short, about 4-6 inchs long, so they had almost completly stopped when i hit them. t

i don't know if this will help but I'm sending you alot of links related to your situation if you need more email me iheartmochaxoxo@yahoo.com as for the fact that your car is from Kansas it depends on the codes for both places as for how the accident should be handled most likely though if you get a police report and send it to your insurance they sould have to comply but I also don't know what kind of insurance you have so that could help too. let me know if you need more help.

"Have accident forgiveness if you've had no accidents with them over the past 3-4..."

There's really not telling how much your insurance will go up, or if it even will. Your carrier may have accident forgiveness if you've had no accidents with them over the past 3-4 years. If your insurance company pays for it, it would depend on how much your rates went up vs paying your friend a $2000.00 chunk all at once. If they only go up by 50.00 every 6 months, by the time the accident came off of your insurance driving record, you would still only have paid out 350.00 vs 2000.00, something to think about.

Q. Minor accident, insurance question?
i had just been in an accident a little over a week ago that i was not at fault for and the other party's insurance company is taking care of all the damages to my car. today i went to get an estimate and right after wards i went to the dealership service center to get my headlight replaced. well in the process of this, the service centers parking lot is packed because we just had a great big snow storm. i went to park in a spot, but i was crooked (because of the lack of manueverability). so i backed up so that i could straighten my car. after i had backed up, i went to change the gear to 1st (this is my first manual car and i am still getting the hang of moving on inclines), however, because of this oddly shaped parking lot, i was on an incline, which means as soon as i let off the break my car would start drifting backwards (not in a fast motion, but there was a bit backwards drif). all of a sudden as i'm drifting backward trying to move forward, the service mechanic in the car directly behind me is pulling out. i don't know if he just didn't see me, or he had thought i was in my space and didn't think to look if i had backed up or what? well as i'm slightly drifting backwards, he backs into my bumper and starts hitting his horn. i don't believe i am at fault for this because i was already out of my spot at the time and trying to move forward when the service tech started backing up. there wasn't much damage to my car, just a bit of minor scratches that could be buffed out. the service techs car (it was a car that he was servicing) had some deep paint chipping on his bumper, however. we did not trade any insurance info, in fact i had just given him my number, as he couldn't find his boss. i was under the impression that they would just buff my car and let me be on my way (according to the service tech). however, as i was getting near my home, he had finally called me and told me that his boss wanted me to come back and exchange insurance info. now i am very weary of doing this as i was just in an accident a little over a week ago that not my fault, however, i don't want to risk increasing my premiums because of some stupid little thing that happened at the service center! i just think its ridiculous for them to want me to come out there and exchange insurance info with their service tech who wasnt paying attention when he was backing up in their cramped parking lot. i don't even care about my bumper as the scratching is barely visible. what should i do? do i go back there and exchange info with him and risk being thrown into the high risk pool of my insurance co. and have them raise my premiums in 5 months? or do i just say the hell with it and be on my way since they don't have any of my info besides my phone number?

Give insurance info and let the insurance companies decide who was at fault (they will anyway, despite how you feel or what you think or how weary you may be) You have insurance.... Use it !

Q. Whose insurance will be raised?
a couple weeks ago i let my grand daughter borrow my car to run up to the store for me. while she was gone, she was in a car accident in the parking lot of hyvee. she gave my insurance because she was in my car. will my insurance be raised, or will her's? we have different insurance companies.

Your insurance will take the primary stance on fixing the other drivers car and any other liability claims that come of it, and it will probably increase your premiums some. The company will not make you add your granddaughter as a driver. It's the same as if you let a friend borrow your car. An important aspect is if you live in a no-fault state. If so, the other driver's insurance will fix their car and may come to your insurance looking for repayment. Either way, you will be covered up to the extent of your policy and your premiums will increase some.

Q. Do i put it on my insurance or pay for it?
hi, i got in a little accident when i was coming out of my building's parking lot, i hit a parked cars rear left bumper causing a little dent. my car got nothing.i left my info on the windshield. and then got an estimate of 400 some dollars. should i put it to my insurance, that is now around a 100 a month and have it in my record and god knows how much they gonna raise my premium, or just go a head and pay for it. ohh plus,,does it matter how much the accident cost for the insurance. i mean is it the same if you get in an accident and crashed the whole car or just got a little bent?? do they count it the same?? thanx

Try to deal it out of pocket, otherwise insurance rates will go up much more. You can check how quotes will change here - carquotes.imess.net

Q. As per washington rules of road when backing out of parking always your fault?
the insurance company said it is always fault of a driver who is backing out from parking lot, is this true? my friend was backing out of parking space at speed like 3-5 miles an hour and dump truck was blocking his way and he did not notice it, the dump truck driver was not in the truck as he was in the back of truck trying to dump garbage. so while backing out from his parking spot, my friend car's right side tail light assembly was broken and there was no other damage to his car neither any damage on dump truck still insurance company raised his premium because they decided it is at fault accident as per wa state law. is it true when you are backing out it is always your fault? irrelevant something was blocking your way? can you give me internet link where i can read about this law?

Yes it is an at fault accident. There is no state law that says you are automatically at fault because you were backing. But many laws place the greater duty of care on the backing car. In your friends case, the dump truck was a parked/unoccupied vehicle. It was a hazard that was there to be seen. If the dump truck was blocking the way - that gives your friend the right to have the dump truck towed....not hit it. Therefore, your friend is at fault for hitting a fixed object. There is no "but he should not have been there for me to hit" defense.
